Plea to include Anil Ambani, Dayalu Ammal as accused in 2G case

Special Judge posts the matter for hearing on May 24

A private complainant on Saturday moved an application in “public interest” in the CBI Special Court dealing with the 2G spectrum cases here seeking the inclusion of Reliance ADA Group chairman Anil Ambani and Tamil Nadu Chief Minister M. Karunanidhi's wife, Dayalu Ammal, as accused in the case.

Special Judge O. P. Saini has posted the matter for hearing on May 24 when the court will hear another application moved by a Ghaziabad resident Dharmender Panday seeking further investigation into the role of Tata Sons chairman Ratan Tata and corporate lobbyist Niira Radia in the case.

The complainant, Dr. Mohammed Furquan, a resident of Inderok here, who stated he was a journalist, alleged “serious lapses on the part of the CBI” in not making Anil Ambani an accused in the case.

Dr. Furquan alleged that senior Reliance ADA Group officials Gautam Doshi, Surendra Pipara and Hari Nair, who are currently in judicial custody after being chargesheeted are “ordinary employees” in the company and that “the offence can not be committed by them without the actual knowledge, connivance and consent of the chairman, Anil Dhirubhai Ambani.”

Dr. Furquan said the CBI's charge sheet alleged that the 12{+t}{+h} accused, Reliance Telecom, had “fraudulently represented” that its holding in the sixth accused, Swan Telecom, was only 9.9 per cent while applying for UAS licences though “it owned the entire share” in Swan Telecom.

“Despite all these facts, the CBI is not taking steps to make Anil Dhirubhai Ambani an accused in this case….Therefore he is a necessary party in these criminal proceedings as prime accused.”

The application also said that Ms. Dayalu Ammal, the 60 per cent stake holder and director in Kalaignar TV, being left out of the charge sheet was an “instance of selecting of accused by the CBI.”

Claiming that the organisation, “Tamil Maiyam” was “under the control” of Ms. Kanimozhi and Dayalu Ammal, the petitioner also attached a list of corporate sponsors and donors who had contributed money to the NGO. The application submitted in court also mentions the name of several companies, some of whom received UAS licences, as donors to “Tamil Maiyam”.

“There is culpable delay in further investigation. Leaving out Anil Ambani and Dayalu Karunanidhi from the array of accused is suspicious and can be only on account of extraneous influence, political or otherwise and calls for interference by this honourable court.”
