The Supreme Court was moved on Tuesday for a direction to the State government to register a First Information Report against Maharashtra Navnirman Sena’s (MNS) chief Raj Thackeray for the violent incidents inside the Assembly on November 9 and for a direction to the Election Commission for deregistering the MNS as a State party.
MNS members had attacked Samajwadi Party MLA Abu Azmi in the Assembly for taking the oath of office in Hindi.
The application filed by Salek Chand Jain was mentioned by counsel Sugriva Dubey before a three-judge Bench of Chief Justice K.G. Balakrishnan, Justices B. Sudershan Reddy and P. Sathasivam for early listing. The Bench, however, said it would come up for hearing in the normal course.
The petitioner had in 2008 moved the court for a direction to take action against Mr. Thackeray for his party’s attack on north Indians in Mumbai and for de-recognition of the party. A notice had been issued and the matter was still pending. In the pending matter, he had filed the present application.
In his application, he said the MNS had no authority to decide what language one should speak in any part of the country and where a citizen should work. The State government and other respondents had not taken any step against the MNS after it started attacking non-Marathi speaking persons and also made provocative statements about non-Marathi persons including representatives of the State. If this was allowed to continue, then the nation would be divided on the basis of language.
Contending that the attack by MNS inside the Assembly was an assault on the Constitution, he sought a direction for registration of an FIR against the MNS chief and de-recognition of the party.
