The fate of criminal proceedings against All India Trinamool Congress (AITC) MP Tapas Paul for making 'rape and shoot' remarks remained undecided in Kolkata on Wednesday with two Judge bench of the Calcutta High Court being divided over the issue.
While Justice Girish Chandra Gupta set aside the single bench order directing the police to register an FIR and the CID to probe the matter, Justice Tapobrata Chakraborty differed on the same and upheld the single bench order.
The matter will be decided by a third judge.
The division bench however extended the stay on single bench order by another three weeks.
"The legal implication is that it is 1:1 now a third judge will decide the matter," State government 's counsel Kalyan Banerjee told journalists.
In the earlier order, Justice Dipankar Dutta had criticised the police for not starting a case against Mr Paul. The AITC MP had made the outrageous comments in June at Nakasipara village in Nadia district which resulted in a huge public outrage.
Following the developments, Biplab Kumar Chowdhury, >the petitioner in the case moved to the Calcutta High Court seeking action against Mr Paul.
