Gujarat riots cases: SC refuses to stay transfer of a judge

The Supreme Court today refused to stay the transfer of a judge hearing the Gujarat riots cases saying it is an administrative matter to be decided by the state High Court.

A special bench headed by Justice D K Jain said these are routine transfers and it has to be decided by the High Court.

The bench turned down the plea of Special Investigating Team seeking its direction to stay the transfer of a judge who has been hearing Naroda Patia case on the ground that the trial is at advance stage and the transfer can delay the outcome of the case.

“These are administrative orders and we should avoid passing orders. If we say that she(the judge) should not be transferred, then same would apply to other cases and the matter would get complicated,” the bench said.

The court asked the SIT to approach the Chief Justice of the Gujarat High Court on the issue.
