The forensic report and the DNA tests in connection with the rape and murder of a 20-year-old woman at Kamduni village in the State's North 24 parganas district last month have revealed that the victim was raped by one of the accused, a senior CID official said here on Saturday.
“We have received the forensic and the DNA reports which prove that Saiful Ali, one of the accused, had raped and tortured the woman (on June 8),” a senior CID official told The Hindu.
Others arrested in the case have also been charged under section 376 D in the charge sheet that was submitted to the court by the CID.
According tothe Criminal law (amendment) Act, 2013, section 376 D of IPC is explained as “the rape of a woman by one or more persons constituting a group or acting in furtherance of a common intention where each of those persons shall be deemed to have committed the offence of rape.”
Punishment for such persons shall not be less than twenty years imprisonment but may also extend to life imprisonment.
According to the CID, though it was Saiful who had committed the sexual offence as pointed out in the DNA report, others accused had assisted him in the crime and therefore have the same charges against them.
