The Bombay High Court on Tuesday framed issues in the probate petition filed by Uddhav Thackeray, Shiv Sena president and younger son of the late Bal Thackeray, to get his father’s will certified by the court.
The late Sena leader’s estranged son Jaidev has opposed the probate, demanding one third share of the property. According to the will, while some portion of the property has been given to Aishvarya (Mr. Jaidev’s son), Mr. Jaidev has been given nothing. Following his application opposing the probate, the probate petition filed by Mr. Uddhav was converted into a testamentary suit.
Justice R.D. Dhanuka who framed the issues, had earlier rejected Mr. Jaidev’s claims. The court held the view that it could not entertain them as they were beyond its jurisdiction and were not maintainable.
