A CBI special court here on Saturday reserved for May 14 order on bail moved by the 2G spectrum scam accused, Rajya Sabha member Kanimozhi and Kalaignar TV managing director Sharad Kumar.

All the other accused, except Cineyug Films promoter Karim Morani, who had sought personal exemption from appearance in court till Tuesday on health grounds, are in judicial custody in the Tihar Central Jail.

Responding to the arguments of Ms. Kanimozhi's counsel Ram Jethmalani, Special Public Prosecutor U.U. Lalit said that going by the charge sheet, the role attributed to her and Mr. Sharad Kumar “is absolutely clear. Their complicity in the entire transaction is clearly made out.”

On the charge sheet description of Ms. Kanimozhi as the “active brain,” Mr. Lalit said it was “an absolutely correct interpretation of the findings. Won't the family that controls 80 per cent shares [in Kalaignar TV] be the controlling mind?”

On Mr. Jethmalani's submission that Ms. Kanimozhi was not involved in the day-to-day affairs of the company, he said: “On paper, Mr. Sharad Kumar may appear to be the signatory of all documents. But nonetheless, the practical facet is that this lady is the controlling hand behind the TV station.”

Noting that first accused, the former Union Telecom Minister, A. Raja, “was definitely close” to Ms. Kanimozhi and not to Mr. Sharad Kumar, Mr. Lalit argued: “It was because of this that Rs. 200 crore from Dynamix Realty found its way to Kalaignar TV.”
