Fresh documents with The Hindu show clear and undeniable links between the sudden transfer of senior IAS official Ashok Khemka and his initiation of a probe specifically related to Congress president Sonia Gandhi’s son-in-law Robert Vadra and his companies, contrary to the Haryana government attempts to establish that the two events were unrelated.
The documents belie the claims made by the Haryana government that Mr. Khemka acted on the Vadra-DLF deals only after his transfer orders were served. Indeed, Congress spokespersons have alleged that he began his inquiry only on October 12 — the date he issued formal orders to this effect — which was one day after he was served his marching orders from the post of Inspector-General of Registration and Director-General Land Consolidation.
However, the internal documents confirm that Mr. Khemka’s first meeting on subject, which led eventually to his order cancelling the mutation of a key land transfer from Mr. Vadra to the real estate giant, DLF, was held on October 8, where the sale deed of village Shikohpur and the mutation papers were called for and examined in the presence of district officials.
‘Mutation’ is the legal term for substitution of the name of one person by the name of another in the record showing right or title to the property.
The reference to the October 8 meeting with other officials is made in passing in an internal memo signed by Mr. Ashok Khemka on October 15 which set out in brief the background to the order cancelling mutation he issued the same day.
The October 15 memo reads: “In view of serious allegations raised in the media by “India Against Corruption” [IAC] concerning the functioning of registering offices and Consolidation Department, the impugned sale deed of village Shikohpur, District Gurgaon along with mutation was called for on 8th October, 2012, when the district officials were present in a departmental inquiry. On presentation of the said document, an order no. IGR/2012/7185-88 dated 12th October, 2012 addressed to the Deputy Commissioners of Gurgaon, Faridabad, Mewat and Palwal was issued u/s 69(1) of The Registration Act, 1908. Another order bearing no EA4/2012/4620-21 dated 15th October, 2012 under section 42 of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948 is made today. The orders are issued to the concerned. May be taken on record of this office.”
This note makes it clear that the process leading to the issuing of a formal order to examine all of Mr. Vadra’s documents began at least three days before Mr. Khemka was transferred.
Other internal papers accessed by The Hindu give an indication of the circumstances in which the decision finally got taken. In a handwritten official note dated October 12, 2012, Mr. Khemka states: “As reported in the press (The Hindu dated 8/10/2012; The Indian Express dated 12/10/2012), it is fit and appropriate to order an enquiry into the registries of lands by Shri Robert Vadra and his companies as regards alleged under-valuations is alleged by IAC [India Against Corruption] and Leader of Opposition of Haryana Vidhan Sabha. In case the allegations are false, the fair name of our registering officer will be cleared in public. In case the allegations are correct, it is appropriate that Shri Robert Vadra compensates the State.....After all, Shri Robert Vadra is a citizen and is amenable to the rule of law like any other ordinary citizen. A detailed order addressed to DCs of Gurgaon, Mewat, Faridabad and Palwal is pasted today and signed. Please issue.”
‘Two-year minimum tenure’
The Hindu also has a Ministry of Personnel, Public Grievances and Pensions (DoPT) notification dated October 13, 2010 revealing that Mr Khemka — who was thrown out of office within three months — was supposed to remain for a minimum tenure of two years at the senior post of Director-General/ Commissioner which he held in the Haryana government.

It is not clear whether the courts can be moved to cancel the transfer
order and restore him to the post till the completion of the inquiry he has directed or else an special investigation team be entrusted with the task.
Any person, however mighty or high he may be, must be punished for serious economic offenses. It's in every one's knowledge how these powerful people subvert the system for personal greed. They know all the lanes and byelanes to hoodwink the people and find an escape route. That's how the infamous 'patronage regime' functions in our country, to the total disadvantage of the common man.
I am looking forward to the day when all such fraudulent mighty ones are punished and their ill gotten material assets are confiscated by the Govt.

The fact that the officer has been transferred 43 times in a career spanning two decades itself vouch for his professional integrity. But the unfortunate thing is people have short memory and media has myriad news items and commercial interests to follow. Eventually this issue will be forgotten. The story will end up Mr. Khema being trnasferred to any remote area to be killed by so called maoists or 'anti national elements'.
Do I sound like an eternal pessimist? Browse your memory for a moment...do you recall anything related to Manjunath, Satyendra Dubey, Narendra Kumar Singh or many slain RTI activists? May be No.

It is so shameful that in spite of so many proofs that openly show that
Haryana Govt. is fully involved in corruption, Haryana Govt. instead of
mending its wrong doings is targeting the honest officer.
We, the citizens of India always believed that the Nehru/Gandhi family are the saviours of this vast country with great diversity.But now they seem to be unmasked.They are themselves law breakers though they lay the law in the Parliament.

Please do not let people of India forget this story. Follow it up and
re-follow it up thoroughly until action is taken. This is blatant misuse
of power by the UPA government and Congress government in Haryana. I am
a fan of Shalini Singh now and also of Mr. Khemka. The only english new
medium I truly believe in India is The Hindu.
If anybody has sufficient fund to manage his/her family, then blindly he should go with KEJRIWAL.
How can anyone expect honsty and ingegrity in bureaucrats,when one is punished? The Cabinet Secretary is said to be the head of the Administrative Servic cadre. When an officer is transferred in three months, the Cabinet Secretary should have his antennae up. When a General does not have the interests of the men under him, what sort of a leader is he? The IAS cadre must unite and stand up to the bullies, for whom the rule of law is an inconvenience. How will the government tackle issues without the administrators? It is a shame that every IAS officr must feel when one of their own is treated so shabbily.
This simply proves that the officer is very honest. Kudos to him and The
Hindu. We don't know whether the corrupt will be punished or not. But
let this honest officer's name stand the test of the time.
There is no moral or ethical logic by congress and harayana government
on Mr. Khemka's decision on ordering probe after his transfer, even if
he has ordered it after transfer. If Mr Vadra is not guilty then there
is no need to worry. Also one need to think about family of Mr. Khemka
who in his 20 years of service got 43 transfers. The industrialists like
Birla, Tata, Premji and Narayanmurthy should come forward and support
people like Mr. Khemka for good governance and better society.
There is nothing wrong in Mr.Khemka's contention, "After all, Shri Robert Vadra is a citizen and is amenable to the rule of law like any other ordinary citizen", even if Robert Vadra happens to be the son-in-law of Sonia Gandhi. The Congress Ministers themselves have told that the deal between Robert Vadra has DLF is a private one and it does not come under the purview of Government for taking any action. If so why were so many of the Congress Ministers and even a Governor of a State, raising their voices in a crescendo trying to shield a private person like Robert Vadra? How many such private have they run to defend previously? The whole episode smacks nothing short of chicanery.
It is essential that the rule of law is established meticulously as in North America to bring sanity in the second largest populated country in the world and the largest democratic state.
