The Supreme Court, on Tuesday, rejected a petition by T.P. Nandakumar, journalist, for an investigation against the Deputy Chairman of the Rajya Sabha, P.J. Kurien, in the Suryanelli gang-rape case.
Dismissing the special leave petition against an October 23 judgment of the Kerala High Court rejecting his plea, a Bench comprising Justice B.S. Chauhan and Justice S.A. Bobde told the petitioner’s counsel: “You [petitioner] don’t have any locus standi to file the petition. Everybody wants to help us unnecessarily. Who are you? If the victim prefers to come here, we will hear her.”
In his petition, Mr. Nandakumar said, “To meet the ends of justice in this case and to prove that no accused can escape from the clutches of law, howsoever influential, and all are equal before the court of law, he filed the petition before the trial court.
But surprisingly, the sessions court dismissed it on the ground that the petitioner has no locus standi in the present revision petition, as the scope of the revision petition was very limited and also on another ground that the matter already became final by the orders of this court in a discharge petition filed by Mr. Kurien.”
