The Kerala High Court on Friday observed that the investigation team was free to probe the solar cheating case filed by Sreedharan Nair in accordance with the law, untrammelled by the findings and observations of the court.
Justice Harul-Ul-Rashid also observed that it was for the investigation agency to decide the method and manner in which the probe should be conducted.
Though the court found that the allegation against the Chief Minster was not true, the court said its findings and observations were confined only to adjudication of the issues that arose in the case.
“The investigation agency shall proceed with the investigation untrammelled by any of the findings and observations made by this court,” the judge observed.
In fact, during the hearing of the case, the judge had orally condemned the remarks made about him in a panel discussion on a TV on reallocation of subjects of some of the judges of the High Court after the Onam vacation. Earlier, this petition relating to the solar scam was heard by another judge. The judge had also roundly condemned the remarks made by one of the panellists that he was a nominee of the Chief Minister. The judge had orally opined that the remarks amounted to denigrating the judiciary.
The hearing also saw Advocate General K.P. Dandapani springing a surprise by submitting that the Chief Minister had been questioned in connection with the complaint of Mr. Nair.
The State government contended that as many as 33 cases in connection with the solar scam were being investigated by the Special Investigation Team (SIT). None of the complainants had raised any allegation against any member of the investigation team or with regard to the investigation done so far.
