The victim in the Suryanelli case on Monday moved the Kerala High Court seeking a directive to appoint the two special prosecutors who appeared before the trial court to make arguments on the appeals filed by the accused before the High Court.
In a writ petition, she said that as evidence in the case was voluminous, it would be next to impossible for the Director General of Prosecution (DGP) and his assistants to go through thousands of pages of evidence and present prosecution versions in the appeal properly and effectively in the shortest time-frame set by the Supreme Court. Besides, the DGP had given adverse legal advice against the petitioner on a complaint field against P.J. Kurien, Deputy Chairman of the Rajya Sabha.
Despite the new disclosures made by the prime accused, Dharmarajan, and others against Mr. Kurien, the government and the police had not taken action against him on the strength of the legal advice of the DGP. Therefore, if the DGP conducted the case, the petitioner would be greatly prejudiced. And the public interest and confidence would be the casualty, she said.
The petitioner pointed out that the government did not consider her representations seeking to appoint Suresh Babu Thomas and C.S. Ajayan as special public prosecutors in the case.
According to her, they were “well versed with the evidence” as they had prosecuted the sessions cases in the special court.
The petitioner sought a directive to the government to appoint Mr. Thomas and Mr. Ajayan as the special prosecutors.
