The sub court, Kottayam has adjourned the execution of the decree in the partition suite filed by Ms. Mary Roy, to October 8.
The execution of the decree was originally posted for Wednesday. The adjournment is for production of the judgment of the Kerala High Court dismissing the petition filed by her brother George Isaac challenging the earlier order of the sub court, Kottayam, directing the delivery of the share owned by Ms. Roy.
It was in 1986 that Ms Roy won her property suite against her brother through a landmark judgment by the Supreme Court that ensured equal rights for Syrian Christian women with their male siblings in their ancestral property. Based on the apex court judgment she had approached the sub court Kottayam in 1988 and then the Kerala High court in 1994 praying for equal share in the property along with her two brothers and a sister.
The final decree in the suite was pronounced in December 2008 and she had filed an execution petition in January 2009.
