A Malaysian national has approached a Magistrate court here seeking Rs.1 crore alimony from her former husband, a medical practitioner, who divorced her according to the Muslim law (triple talaq) nine months ago.
Amina Bindi, 34, has moved the petition against her former spouse, C.T.V. Ismail, 44 of Puthuppanam, Kannur district, under Section 3 a (reasonable and fair provision and maintenance to be made and paid to her within the iddat period by her former husband) of the Muslim Women (Protection of Rights on Divorce) Act, Abdulla Manapurathu, counsel for the petitioner, said.
Power of attorney
Her father’s brother, K.P. Kunhamed, has been given the power of attorney to fight the case.
The Vadakara Judicial First Class Magistrate has served a notice on the respondent and posted the case to January 7.
In her petition, Ms. Bindi, said that Mr. Ismail, who pursued his studies in Malaysia, had married her at Kuttiyadi in the district on August 28, 2002.
The couple has two children. However on February 8, 2012, he divorced her.
Her father, Ibrahim a native of Kuttiyadi, had married a Malaysian woman, and he had subsequently obtained citizenship of that country. He gave his daughter in marriage to Ismail and also spent a huge amount of money for the latter’s medical education in Malaysia and Russia, Mr. Manapurathu said.
As per the Muslim Women (Protection of Rights on Divorce) Act, a Muslim woman who has married according to Muslim law and has been divorced by or has obtained divorced from her husband in accordance with the Muslim law could seek maintenance from her former husband.
