A Division Bench of the Kerala High Court on Tuesday upheld a single judge’s verdict holding that the police were free to handcuff an accused if they feared that the accused would escape. The Bench comprising Acting Chief Justice Ashok Bhushan and Justice A.M. Shaffique made the ruling while dismissing a petition filed by Bineesh, a convict in the 2005 Kanichukulangara triple murder case. The convict challenged the police action in handcuffing him while taking him to courts.
