Court upholds 50% quota in Kerala

Dismissing a writ petition filed by Mayank Bharti, Justice A. Muhamed Mustaq said no relaxation had been made on the merit of the candidates for the reserved seats.

The Kerala High Court on Tuesday upheld a State government decision to provide 50 per cent seats exclusively to Kerala-born doctors during admission to postgraduate medical super-specialty courses for 2014.

Dismissing a writ petition filed by Mayank Bharti, Justice A. Muhamed Mustaq said no relaxation had been made on the merit of the candidates for the reserved seats. They were required to satisfy the minimum qualification prescribed by the MCI regulations for admission to the quota. The court added that in the absence of compromise on the merit of the candidates, the classification for admission by a separate source based on intelligent criteria could be justified. The government had equally provided 50 per cent of seats for general candidates. Thus, the State government had acted impartially and without any parochial interest.
