Uncertainty over HKES elections

Office-bearers must take charge by March 31

With exactly one month left for the new office bearers to take over the reins of the Hyderabad Karnataka Education Society (HKES), which runs a chain of educational institutions, an air of uncertainty prevails over whether the elections to elect the new office bearers would be held or not in time.

As per the bylaws of the HKES, the new office bearers would have to take charge on or before March 31. A state of confusion prevails in the society on holding elections after the Gulbarga Bench of the High Court of Karnataka quashed the amendment to the bylaws of the HKES, restricting the membership and giving total powers to the managing council of the society to accept new membership or reject it.

The court, in its order delivered on February 12, further stated that the elections should be held after enrolling the new members.

The court had also asked the society to restore the membership of the managing council of the society to its original size of 21 instead of 13. As per the bylaws of the society, the dates of the election of the office bearers and members of the managing council, should be decided in a special meeting of the council. The managing council in its special meeting should appoint the returning officer besides announcing the dates of calendar of events.

Appeal

The attempt to file an appeal against the order passed by a single judge before the Divisional Bench of the High Court also failed with Judge A.S. Pachapure recusing himself from hearing the case. The appeal is likely to come up before another bench on Monday.

Everything now depends on the appeal filed by the HKES before the Division Bench of the Gulbarga Bench of the High Court of Karnataka.

If there is a delay in getting relief , the elections cannot be held to the society and the government would have no other alternative but to appoint an administrator till the issue is settled.
