SC urged to call for status report on AMC cases

Samaj Parivartana Samudaya has moved the Supreme Court stating that a status report be called from the Central Bureau of Investigation with respect to the prosecution launched by it in the Associated Mining Company (AMC) case and issue a direction for expeditious prosecution and a time-bound conclusion of trial, according to samudaya founder-president S.R. Hiremath.

Releasing copies of the submission made to the Supreme Court at a press conference here on Wednesday, Mr. Hiremath said that pursuant to the Supreme Court order, the CBI filed a charge-sheet in the Associated Mining Company case on May 30, 2012 arraying the former Minister Gali Janardhan Reddy as accused number one and his wife, Lakshmi Aruna, as accused number two.

Despite the gravity of the offence involved and the indictment of the accused persons by the CBI, the Special Court acted in an arbitrary manner and discharged the accused ignoring the evidence submitted against the accused. The CBI till date has not taken any legal action to challenge the discharge order passed by the special judge. This shows the callous manner in which the CBI works. The investigating agency had failed to file a status report on cases related to Associated Mining Company. It had also failed to file a status report on cases related to Deccan Mining Syndicate, in which the same special judge discharged all the accused, he said.

The samudaya had, in its submission, brought to the notice of the Supreme Court that there had been numerous complaints against the presiding officer of the special court trying the cases involving Associated Mining Company. Even the CBI had moved an application for transfer of cases pending before the presiding officer to another court.

During the pendency of the application, the presiding officer discharged the accused number two (Ms. Aruna). After the discharge order was passed, the presiding officer was transferred from Special CBI court to a family court. The CBI had also filed a complaint against the judge, Mr. Hiremath added.
