The High Court of Karnataka on Thursday rejected a petition which had questioned the election of G.H. Srinivas of the Congress to the State Legislative Assembly from Tarikere constituency in elections held in 2013.
‘Misled voters’B.R. Neelakantappa, one of the candidates who contested the election, had filed the petition alleging that Mr. Srinivas had indulged in corrupt practices and also mislead voters. The petitioner also questioned acceptance of nomination papers of one D.S. Suresh alleging that he had not provided proper particulars of his bank statements.
While Mr. Srinivas had secured 35,817 votes, Mr. Suresh got 34,918 votes. The petitioner had secured 415 votes.
However, in his verdict, Justice A.S. Bopanna said that the petitioner had not only failed to submit the affidavit, in support of his allegation of corrupt practices, in a proper format but had failed to produce material to support his allegation except make “bald” accusations against the elected candidate.
The court upheld the contention of Mr. Srinivas that the petition did not contain any issue that required to be subjected to trial under the Representation of People Act.
