The Karnataka High Court on Friday directed the prison authorities to let Kudligi MLA B. Nagendra stay at Kumara Krupa guesthouse till January 30 to enable him to “effectively prepare” and attend the ongoing session of the State Legislative Assembly.
This would avoid the need to bring him every day from the Bangalore Central Prison at Parappana Agrahara to the Vidhana Soudha.
Justice H.N. Nagamohan Das passed the order on a petition filed by Mr. Nagendra questioning denial of permission to stay at a guesthouse by the Special Court for CBI cases.
The CBI counsel objected granting of permission to stay outside the Bangalore Central Prison as Mr. Nagendra is in judicial custody after being arrested in connection with a corruption case related to illegal mining and transportation of iron ore.
Mr. Nagendra had contended that it was difficult for him to travel all the way from the prison to the Vidhana Soudha every day to attend the proceedings.
However, the High Court declined to accept the CBI counsel’s contention and said the MLA is “required to stay in an environment which is conducive to prepare for effective participation in the proceedings of the legislature”.
The court said all other conditions imposed by the special court would remain.
