Judge recuses from hearing Dayalu’s plea

Justice Veena Birbal of the Delhi High Court on Wednesday recused herself from hearing a petition by Dayalu Ammal, wife of the former Tamil Nadu Chief Minister, M. Karunanidhi, who had expressed her inability to record her evidence in the 2G spectrum allocation case as she was suffering from Alzheimer’s disease.

Justice Birbal had on Tuesday posted Dayalu Ammal’s petition for hearing on Wednesday asking her counsel to argue on its maintainability when CBI counsel informed the judge that the Supreme Court had restrained the High Court from entertaining any petition in connection with the case.

Justice Birbal did not give any reason for her recusal. The petition will now be heard by a different Bench on Thursday. Ms. Dayalu Ammal urged the court to get her examined by a medical board to see whether she was fit to record her evidence.
