The Central Bureau of Investigation has furnished documents sought by the Union Law Ministry for giving a legal opinion on whether the agency needs to obtain sanction for prosecuting Intelligence Bureau officials in the Ishrat Jahan encounter case.
According to sources, the Law Ministry had recently replied to the CBI query asking for some more supporting documents, stating that it was otherwise not in a position to give a legal opinion.
“Accordingly, we supplied the documents to the Ministry and are expecting a response on the legal opinion,” a senior CBI official said.
While the agency has filed its first charge sheet in connection with those directly involved in the alleged fake encounter, it is presently probing the conspiracy part.
IB officials’ roleAccordingly, the role of the then Intelligence Bureau officials — retired Special Director Rajendra Kumar and three others, P. Mittal, M. K. Sinha and Rajiv Wankhede — were also investigated.
The four were questioned by the CBI on suspicion of their involvement in the conspiracy to “stage-manage” the encounter in which Ishrat and three others were gunned down.
