The Bombay High Court on Monday raised technical issues over an application filed by the Central Bureau of Investigation (CBI) for the deletion of the name of former Maharashtra Chief Minister Ashok Chavan from the charge sheet of the Adarsh scam.
The court asked if such an application could be moved under Section 169 of the Criminal Procedure Code after the charge sheet was filed, or if Section 321 should be invoked. The CBI said there were enough judgments to show that Section 169 was applicable. The court will now hear the matter on September 22.In April, the CBI moved an application for permission to delete Mr. Chavan’s name, saying the Governor had refused permission to prosecute him. The High Court then halted the trial against Mr. Chavan, but clarified that the trial of the other 12 accused could go on.
Senior civil and Army officials and politicians have been named in the scam, which cost Mr. Chavan the post of Chief Minister.
