Former Judge of the Supreme Court V.R. Krishna Iyer has said that the day that activist Binayak Sen was granted bail by the Supreme Court was an auspicious one.
“Bail or jail is jurisprudence in its finest dimension,” Justice Iyer said in a statement issued here on Saturday.
“I laid down the law of bail which I presume still holds good. Now that the Supreme Court has granted bail, I hope that the courts of India will develop this divine liberty dimension of aspects of bail justice,” he said.
The statement added that Justice Iyer was happy that the “finest hour of under-trial justice” had found expression in Dr. Sen's case, and that it was a victory for all those who believed in human rights.
“I have founded in my time this jurisprudence that the courts of India herein after will be liberally generous in grant of bail. It is recognition of the proposition that bail is the rule and jail the exception. Personal liberty has a divine dimension which I consider is humane jurisprudence and not jejune jettisoning of the glorious universal law of personal liberty,” Justice Iyer said.
