Fast-track courts violate due process: A.P. Shah

Fast-track courts are not the solution to the problem of judicial backlog, Law Commission chairperson Justice A.P. Shah told The Hindu in an interview. The Commission recently submitted its report on judicial delay to the Law Ministry.

Stating that the quality of justice being delivered by fast-track courts was problematic, Justice Shah said there was often a violation of due process.

To unclog the judiciary, traffic and police fines — which the commission found make up over a third of the lower judiciary’s cases — need to be removed from the court system, Justice Shah said. “Courts should be really dealing with serious criminal offences, not with petty cases. The court system is already bogged down with institutions and arrears,” he pointed out.
