Dayalu Ammal asked to move Supreme Court

NEW DELHI: Admitting the CBI’s submission challenging maintainability of Dayalu Ammal’s petition against a lower court order dismissing her plea to exempt her from recording evidence in the 2G spectrum allocation case, the Delhi High Court on Thursday asked her to approach the Supreme Court for relief. Dayalu Ammal is the wife of the former Tamil Nadu Chief Minister M. Karunanidhi.

Dismissing her petition, Justice Sunil Gaur said he could not hear the petition on its merits as the Supreme Court was seized of the matter and monitoring it.

He directed the trial court not to take any coercive step for her appearance to record her evidence as a prosecution witness till Monday.

The trial court had summoned her for July 8.

Dayalu Ammal says she cannot record her statement as she is suffering from Alzheimer’s disease.

The investigating agency argued that the Supreme Court restrained the High Court from entertaining any petition in connection with the 2G case.
