The Supreme Court on Monday sought the Centre’s response on a petition filed by Janata Party president Subramanian Swamy seeking fresh interpretation of the term ‘juvenile’ under the Juvenile Justice (Care and Protection of Children) Act.
Dr. Swamy contended that instead of the 18-year age limit, the “mental and intellectual maturity” of such offenders be considered while determining their culpability.
A Bench of Justices K.S. Radhakrishnan and Dipak Misra, while asking Dr. Swamy to serve a copy of the petition on the Union of India, directed the petition to be tagged with a batch of similar ones on which notice had already been issued.
