Bail pleas of 5 corporate honchos dismissed

A special court here on Wednesday remanded in judicial custody and sent to the Tihar Central Jail five corporate bigwigs, named in the CBI charge sheet in the 2G spectrum case, after their regular bail applications were dismissed.

The five who joined the former Union Telecom Minister, A. Raja, and five other accused in the jail are Unitech managing director Sanjay Chandra, DB Realty managing director Vinod Goenka, Reliance ADA Group managing director Gautam Doshi, Group president Surendra Pipara and senior vice-president Hari Nair.

Following rejection of their bail pleas, counsel immediately moved interim bail applications. The accused prayed for status quo on their personal liberty for 15 more days to enable them to file bail applications in the Delhi High Court.

The regular bail plea was moved on April 13 and heard on April 15 before Special Judge O. P. Saini reserved orders for Wednesday.

Opposing the interim bail plea, senior public prosecutor A. K. Singh, who appeared for the CBI, said the court had no power to grant status quo or interim bail after dismissing the regular bail applications.

After Mr. Saini dismissed the applications for interim bail and maintenance of status quo, counsel told journalists that they had moved the High Court, which would hear the bail applications on Thursday.

Mr. Saini, in a 42-page order, said: “A bare perusal of the facts of the case and allegations in the charge sheet makes it out as a case of the highest magnitude and gravity and there is enough incriminating material on record against the accused … In such cases, non-arrest of the accused by the CBI is of no consequence and bail is to be considered as per the facts and circumstances of the case.”
