The Supreme Court on Thursday issued notice to the CBI on a petition filed by YSR Congress (YSRC) president Y.S. Jaganmohan Reddy seeking bail in the cases registered against him by the agency.
A Bench of Justices Aftab Alam and Ranjana Desai issued notice after hearing senior counsel Ram Jethmalani, appearing for Jagan.
The Bench, however, dismissed another petition filed by Jagan challenging the grounds of his arrest.
In his appeal against the A.P. High Court order dated July 4 dismissing his bail plea, Jagan said there was complete and utter misapplication of the principles governing bail jurisprudence by the High Court and this had led to a continuing deprivation of his rights under Article 21 of the Constitution.
He said the CBI had wholly failed to show even a shred of proof to suggest that he would tamper with evidence or influence witnesses. In fact, the High Court had also ignored the basic fact that for over nine long months and three charge-sheets after the registration of the FIR, he had enjoyed his freedom without any complaint of influencing more than 150 witnesses listed.
He said, “It is trite to say that merely being wealthy or in public life cannot disqualify an accused from the basic protection afforded by the law. Despite the fact that ‘Bail, Not Jail’ is the norm, the High Court has relied on extraneous factors, including the alleged loss of public money, which was yet to be proved.” The High Court had concluded that bail ought to be denied to him simply because of his political position. He said he never interfered with the investigation nor did influence any witness at any point of time.









Good Job Supreme Court. There is a institution that is afterall looking
out for the common man, whether CBI is doing it's job or not. Looks like
Ram Jethmalani is a star defense counsel in all big-wig politico's big
scam bail pleas. He appeared for Kani for a 214 crore bribe, now YSR for
375 crore DA, is he a member of BJP or is he about to be expelled for
betrayal of party principles? Or is it all these politicos coming from
the same pond?
The politics stink. Here is one, who evaded income tax and is liable for
punishment, but his supporters oppose the action taken by the I.T dept.
If there is evasion of a few thousands from any small guy, He is
punished. Come what may, who ever commits a mistake should be hauled up
and punished.
This is political vendetta as most Indian politicians are corrupt. Indian agencies including the CBI are influenced by political leaders and the Malayalee mafias that are biased. Bofors scandal, 2G Scam, Vote for Cash scandal and several others are well known to all.
what are the various principles for grant of bail ?
Yes, we all stand in favor of Justice and supreme court decision.
Obviously this highly corruptive politician is looted (billions) public
money and throughing money to all. Money should not win only Justice
and Peace should win.
The Govts or Courts should take away his billions of rupees and utilize
for Public development and manufacturing projects.
Step by step we need mitigate/eradicate corruption from all walks of
life. God willing and Lord will save the Dharma.
Let strive for best and justice for all.
Let the truth come out. It is becoming extremely difficult to punish the
guilty. Hopefully this case will be taken to its logical conclusion
Rightly so.
