The Supreme Court on Friday ordered a CBI enquiry into the former Karnataka Chief Minister, B.S. Yeddyurappa for illegalities in mining activities, in which he allegedly used his public office to grant undue favours to mining companies, who in turn made several large “donations” to a trust maintained by his immediate family.
Taking note of the complete failure of Andhra Pradesh and Karnataka in protecting forests and minerals from being illegally mined and exploited, the Special Forest Bench headed by Chief Justice S.H. Kapadia observed: “Wherever and whenever the state fails to perform its duties, the court shall step in to ensure that rule of law prevails over the abuse of the process of law.”
The Bench said, “The CBI shall undertake investigation in a most fair, proper and unbiased manner uninfluenced by the stature of the persons and the political or corporate clout, involved in the present case.”
The court gave the CBI three months to submit a report.
A special investigation team will have to be headed by an officer not below the rank of Additional Director-General of Police or Additional Commissioner.
Proceedings stayed
All other judicial proceedings related to the case were stayed and the Andhra Pradesh government as well as other State agencies in Karnataka were asked to cooperate with the CBI in the investigation.
“It will be open to the CBI to examine and inspect the records of any connected matter pending before any investigating agency or any court,” said the Bench.
“The basic purpose of an investigation is to bring out the truth by conducting a fair and proper investigation, in accordance with law, and ensure that the guilty are punished,” it noted.
Accepts panel report
The April 20 report of the Supreme Court-appointed Central Empowered Committee, which implicated Mr. Yeddyurappa, said there was due cause to include him in a CBI probe. This was accepted by the court.
Mining companies were also implicated in the report, which stated that they were the recipients of illegally mined material and that there was proof that undue favours were shown to them by Mr. Yeddyurappa.
The matter was posted for further hearing on August 30.

It is good that Mr.Yeddyurappa, who is implicated in Mining scam, is investigated through CBI at the instance of Supreme Court of India. This will bring out the truth. To avoid the reality and its punishment, Mr.Yeddyurappa wants to become the chief minister of Karnataka. It is sorry state of affairs that few ministers and few MLAs are joining with him. Perhaps they also may be having link in the mining scam.
The Chief Justice of India's observation that the highest Court of this nation "will interfere if the States are not functioning with rule of law" is received well by the law abiding citizens of India.We the Indians are cornered by these political commission agents whose main aim is to loot the wealth our nation. The Karnataka BJP leaders have crossed all limits in destroying the mining wealth.We were wondering when ever the BJP's ex-Chief Minister donated crores of rupees to the temples he visited,as to how these politicians are bribing even GOD's for their sin.

There is an old saying from ancient Greece "The wheels of justice may grind slowly but they grind exceedingly small". I hope the saying is also true in modern India and that the public fully supports the Judges from doing their job of dispensing justice with determination and persistence.
Here is a man who puts up a brave face even after all the evidence that
is available shows the opposite. Will justice be served, time will tell.
Will the CBI investigation help, i strongly doubt that. The CBI has
never been independent and pretty much tipping towards the congress. And
what about the companies a.k.a politicians that profited from this, will
we get that illegal money back.
I would like to pass kudos to the effort put by our investigating team. On the other, the onus of punishing the offenders lies in the hands of govt. As we have experienced the same over the times , justice to corruption related matters looks a rara avis.

Yeddyurappa, can go in Jail on willfull misconduct because the will full misconduct comes under Sec 13 Prevention of Corruption Act 1988 .And the Govt of India has done latest and biggest reform in Indian bureaucracy that govt of India will give permission for Prosecution on will misconduct and Criminals misconduct with in Three months

Alas ! We have been reading and watching since long time ago, the inquiry directives of various courts of law including the current one from SC but no proof of concrete action taken and the guilty punished so far, especially of the cases related to corrupt politicians, bureaucrats and corporates. What is actually going on? we, the subjects of India do not know. Is this called democracy? No way ! We are in this way, only sadly depriving mother India off her true and solemn modesty, if it is to be put in proper and actual context. We as Indians with quite few exceptions, mostly are spineless and shameless to silently endure such onslaughts on our societies, which constitutes mother India ! Noticeably, even the uprising caused recently by Anna Hazare movement also have died down misereably due to their lack of conviction, integrity and inner politics and corruption. May GOD save India from such corrupt indians ! Jai Hind !
Mr.Yediyurappa escaped from the probe in mining scam on the lokayukta report given by Mr.Santosh Hegde due to a techincal point in the high court of Karnataka. Now SC has done a great job in ordering the proble by CBI. Mere technicality that Lokayukta has not sent a letter seeking his clarification before being implicated in mining scam is too lenient a interpretation of the law. Mining scam is not some departmental enquiry to seek clarification of all the accused. It involves about 2000 people and about 16000 crores of public money and resources. If lokayukta kept asking for clarifications from all these people it would have taken 100 years to present its report. By that time all the people involved would have died a natural death and all the mines in bellary would have been looted. Hope CBI does a thorough probe and implicates the guilty. Most important thing would be recovery of looted wealth from these people , after all it is People money.
