It dismisses as “false and fabricated documents” fax messages claimed to have been sent by Sanjiv Bhatt
The Supreme Court-appointed Special Investigation Team has totally disagreed with the observations of amicus curiae Raju Ramachandran, and said no case can be made out against Gujarat Chief Minister Narendra Modi in connection with the 2002 communal riots under any of the Sections of the Indian Penal Code mentioned by him.
Mr. Ramachandran, in his report, which formed part of the SIT closure report submitted in the Ahmedabad metropolitan court, observed that prima facie offences under Sections 153 A (1)(a) and (b), 153 B (1)(c), 166 and 505 (2) of the IPC could be made out against Mr. Modi for his alleged “instructions” to police officers to “go soft on the Hindu rioters” and his subsequent role in handling the riots and alleged offensive media statements that could have contributed to instigating violence.
Giving point-by-point answers to all observations made by the amicus curiae after investigating the charges, as directed by the Supreme Court, the SIT said: “The offences under the aforesaid sections of law are not made out against Mr. Modi.” The report signed by the investigation officer in the Zakia Jafri petition case, Deputy Commissioner of Police Himanshu Shukla, said, “in the light of the aforesaid facts, a closure report in being submitted for favour of perusal and orders.”
(Ms. Jafri, wife of the slain former Congress MP Ahesan Jafri, levelled serious charges against Mr. Modi and 62 others in connection with the communal riots.)
The SIT dismissed as “false and fabricated documents” two “fax messages” claimed to have been sent by the suspended IPS officer Sanjiv Bhatt, who was then Deputy Commissioner in the State intelligence branch, to the Chief Minister and Minister of State for Home Gordhan Jhadafiya, with copies to the Ahmedabad Police Commissioner, the State police control room and others, alerting them about the developing communal situation.
The “fax messages,” which claimed that the Chief Minister was informed in advance of the tension building up in Gulberg Society and that the city Police Commissioner was informed of the need for advanced preparations for possible communal repercussions in view of the government's decision to bring the bodies of the victims of the Godhra train carnage to Ahmedabad, were cited as examples of “dereliction of duty” on the part of the Chief Minister, his Cabinet colleagues and the senior police officers.
Concocted fax messages
The SIT found that no such fax messages ever existed and that these were concocted by Mr. Bhatt at a much later stage and the signatures of his superior officers were forged. Neither those claimed to be recipients nor the purported senders in the State or city police control rooms or the control room of the Home Ministry remembered anything about receiving or sending any such message. Office records did not show the existence of any such message and there also was no mention of the numbering of these messages in the subsequent official messages, which normally was the practice.
The SIT report pointed out that Mr. Bhatt himself did not mention about the existence of these messages in any of the affidavits or statements he had filed before numerous authorities all these years. For the first time, he produced a “copy” of the messages before the G. T. Nanavati-Akshay Mehta Judicial Enquiry Commission in December last and subsequently before the SIT in January this year.
Pointing out that Mr. Bhatt did not mention about the fax messages when SIT official A. K. Malhotra questioned him in connection with the Zakia Jafri petition in 2009, nor during the investigation by Mr Shukla in 2010, the SIT report said: “The oral and documentary evidence available on record would therefore conclusively prove that these fax messages now produced by Mr. Bhatt have been fabricated subsequently with an ulterior motive. No reliance can, therefore, be placed upon both these fax messages.” The SIT virtually exonerated the then Police Commissioner, P. C. Pande, his deputies M. K. Tandon and P. B. Gondia and some other police officers of the charge of dereliction of duty, and said the investigation proved that they had tried to curb the riots to the best of their ability given the limited resources available at their command to deal with the rapidly deteriorating situation. When the police arrived at any scene of riot, “the violent mobs hid themselves in lanes and bylanes and regrouped and resumed violence” as soon as the police left to attend another complaint. The SIT said it was not possible to withdraw the entire police force from the known communally sensitive areas for deployment in areas like Gulberg Society or Naroda-Patiya which had no communal history in the past.
Appreciation for Pande's role
The SIT appreciated the role played by Mr. Pande in dismissing a mob which was attempting to set fire to a dargah adjacent to the Police Commissioner's office. It pointed out that Mr. Pande heard some noise when he was in the office in the afternoon of February 28, 2002, and came to know that a mob was trying to vandalise the dargah. With the available police force by then dispatched to Gulberg Society, he took only an armed guard and succeeded in chasing away the violent mob and saved the dargah.
The SIT report, giving details of the roles played by different police officers and how they attempted to handle the situation, said there was no indication that the police were given any instruction from the higher-ups not to act or leave the affected areas to the mercy of the riotous mobs.
About the observation by the amicus curiae that the then Vishwa Hindu Parishad State general secretary Jaideep Patel being “handed over” bodies of the train carnage victims for transport to Ahmedabad was indicative of an instruction having come from “somebody very high,” the SIT pointed out that all through the journey by road from Godhra the five trucks which carried the bodies were accompanied by the police officers concerned and handed over to the police officers in charge at the Sola civil hospital in Ahmedabad. As the bodies were those of VHP kar sevaks, Mr Patel was allowed to accompany the police during the journey. The then Godhra mamlatdar and executive magistrate, M. L. Nalvaya, “erroneously” prepared the handing over papers in the name of Mr. Patel, for which the SIT recommended departmental action against him. But there was nothing to show that Mr. Modi had ordered the “handing over” of the bodies to Mr. Patel.
The SIT also dismissed Mr. Ramachandran's observations about “positioning of the two Cabinet Ministers at the instruction of Mr. Modi” in the State and the city police control rooms with the intention of interfering with the police functioning, and said its investigation proved that late Ashok Bhatt did not visit the city police control room except briefly on March 1 to pick up the then Defence Minister, George Fernandes, who was discussing with the City Police Commissioner deployment of the Army. The then Urban Development Minister did visit the State police headquarters in Gandhinagar for about a couple of hours on February 28, but was made to sit in an empty cabin and he never entered the control room. “There is no proof that they were either acting at the instruction of the Chief Minister or had even once interfered with the police functioning.”
Charges not substantiated
The report said the allegations of Mr. Modi making provocative statements over the media could not be substantiated. The allegation of his having told Zee TV in an interview that the Gulberg Society massacre was the “result of the provocative firing from inside” by Ahesan Jafri could not be established as the channel, despite several reminders, did not produce the CD of the recording. The second instance of The Times of India quoting him on Newton's theory of action and reaction to justify the riots as a reaction to the Godhra train carnage was also found baseless. The State Information Department promptly issued a denial that Mr. Modi did not speak to The Times of India at all and the newspaper was forced to carry the denial, though deliberately in an obscure corner, the SIT said.
It also dealt with the alleged “shoddy” handling of the post-riot situation by the government under Mr. Modi, and said action was recommended against the officers responsible for inaccurate police investigations or the alleged “political appointments” of special public prosecutors to handle the riot-related cases.

Butchering of thousands of innocent Sikhs in the wake of Indira Gandhi's assassination did not attract as much extensive condemnation as does the Gujarat killings post-Godhra.This is not to say that the Gujarat killings are less heinous but to drive home the point that more than concern for the Gujarat victims, Modi-baiting is serving the ends of politicians and a section of the media.Since the anti-BJP constituency in the country is larger,this is happening.It is sickening for the country to be tied down to Gujarat obsession interminably.The longer the issue drags the stronger the country will be mired in divisive politics.
People should note that it is Mr. Dasgupta who has written this article. The Hindu has just published it, I am sure for a good amount. I would like to point out to those throwing allegations at Mr. Raghvan that Mr. Raghavan is an invetstigator by profession and known for his integrity. Only a filthy newspaper like TOI can accuse him of getting sold for one trip to London. It is Mr. Raju Ramchandran who is an attorney by profession and works (only) for money on case by case basis. It is at anybody's own discretion as to how mcuh respect to give to an attorney. And 'Amicus Curie' has no legal support in constitution and apex court went out of their way and extra mile to satisfy Zakia and her friends in media and congress party

After Godhra kand - 2002 we have not seen any more riots in Gujarat, which itself is a proof that hatred is not in his vision. We have seen Muslims and Hindus on television saying that they are very happy and observing best of their life time in Gujarat with a perfect harmony. Mr. Modi is working and making Govt to work for the people of Gujarat and not for majority or minority. Hats off to Mr. Modi’s wisdom. Its very disheartening that some section of media and activists are
throwing aspersions on Mr. Raghvan and Mr Raju charachter. Both are
people of very high repute and are not that kind of persons who can be
influenced by religious emotions or sycophancy. Remember, that the
same SIT and justice system has convicted people for so many riot
cases in Gujarat. It's duty of s Mr. Raju (court's advisory) to take
all accounts (true or false), so that SIT (an investigating agency )
can probe his thoughts. People must not think that if Mr Modi is not
convicted then no justice delivered. Also, our SC is highly 'secular'
in nature. This case is looked by both Muslim and Hindu judges. I want
courts to deliver the judgement and convict guilty people in due time.
It is not surprising the conclusion reached by the SIT is in favor of the authorities. If we Indians ask our hearts, we know that you can't fight against authority in this country. Money is enough to kill justice, they have power too. But painful is the fact that a lot of us decide to close eyes and pretend that the authority are their savior. What will they say if the same police turn a blind eye and allow goon to kill somebody they know? This report shows that 'a few' police officers were able to prevent the vandalism at the dargah. Surprise is the least we can feel when they say despite all their effort with all the force, they could not prevent the death of thousands of people.
It is shocking to learn that for 10 years media was feeding us lie regarding what Modi said to Zee TV and Times of India. It is also shocking to learn that Sanjeev Bhatt, who has been projected as hero by media has so many loopholes in his story.
But I think none of the above matters anymore. People have already formed their opinions against Modi by 10 years of conditioning by media and no matter of evidence in support of Modi will make them change their opinion because now their belief is no longer open to scrutiny of evidences and logic.
At the end, just want to thank The Hindu for publishing this because I am totally surprised that other media haven't even covered this important information.
The Hindu and Manas Dasgupta along with R K Raghavan-led SIT seem
to have undertaken the onerous task of defending Narendra Modi
against all charges of his complicity in the 2002 Gujarat
genocide. But the fact remains that all the information brought
out by the media(The Hindu having a major role), and human rights
activists in India and abroad, have left no doubt in the minds of
the discerning public that Modi supported, if not masterminded,
the communal carnage using his official capacity. The SIT is
dismissing all charges pointed out by the amicus curiae citing
absence of records, ignoring the possibility of their having been
destroyed or manipulated by the authorities, who themselves are
the accused, and have admitted destruction of intelligence
records due to passage of time and as per govt rules. All those
who have testified against Modi, including former ADGP and senior
police officials, are described as tainted, unreliable,
motivated, people with an axe to grind etc, etc.Alas!
It seems Arnob Goswamy read SIT's rebuttal to Raju Ramachandran's report; that is why
he took a day off from Times Now yesterday. A day when Raju Ramchanran's report
was made public he was in ordinary jeans and tee shirt on TV at noon time. He was
prosecuting Mr. Modi on TV; at the same time he was juror and judge. He found Mr.
Modi guilty of all the charges and he pronounced a verdict of guilty as charged. Only
thing he did not do pronounce the punishment. I am glad The Hindu has behaved in
much matured manner in giving honest reporting.

Reading from some of the above comments....I wonder how people still recall the riots as Massacare or Genocide???
Do they totally ignore the fact that People from both the community suffered during these 2 months? Do they really think all people who died in the riots were from only one community? And I wonder how the number of people who lost their life in riots keep increasing every year...??

Curiae hasn't implicated Modi, he simply lists (which I found
unwarranted) penal codes that can be applied if Sanjiv Bhatt is true.

No piece of paper/report can fill the void of sorrow felt by the riot victims.I too agree and respect the judicial institution of our country. Lets for a moment declare Modi as innocent. The conclusions reached by the SIT and Amicus Curiae are diametrically opposed to each other. The real truth may perhaps lie somewhere in between which will be hard or even impossible to get at given the strong emotions that had already muddied the situation over the years. While the SIT is forthright in refuting point by point the position taken by the Amicus Curiae which in the eyes of dispassionate laymen depends heavily on probables, possibles and surmises, what is beyond doubt is a systematic relentless campaign is on to politically finish off a good administrator that Modi is believed to be.
Either of the reports is wrong. Is there any provision of law to punish the person who has given wrong report.it is high time to do so.there is no end to such issues because any authority is not responsible for wrong doing. Our money is being wasted.

Very well said. Also, the employment rate in Gujarat is best in India. It is not only for certain caste or people. Agriculture to Industry everything is booming in Gujarat.THIS IS NOT POSSIBLE without RIGHT ATTITUDE. I know people who were working in Godhra in 1984 and the autowalas there used to say that we will make small Pakistan here. You can not do anything. Considering the fact that SIT was constituted by Supreme court and the
team was led by Raghavan,the matter should come to rest.How long we

The media has been shouting offences at Modi for a decade. He has borne the brunt for too long. He has been given clean chit in all false cases against him.. But more importantly the media should realize that in a riot, the mob rules not a leader. Politically motivated people like Setalvad etc have called him a mass murderer, and the media gave wind to those rumors, just because it jelled with its political agenda or it was hot news to be sold. Now that it has been proven by investigators from outside (yes nobody in SIT from Gujarat or any sympathy for Modi). New SIT Report : There was no Riot happened in Gujarat in 2002. At the time Modi was in America. Muslims commit suicide by setting fire and cut each others' throats so there was no connection with any Hindus.
Its really surprising that how could an Amicus Curiae be totally dismissed in such a fashion. If all that Amicus Curiae has reported is totally out of context ,and what Zakia and Mr. Bhatt is telling is a total lie, then it would be really tough to accept the opinion of SIT as well. Remember all that SIT is doing is in within the geographically administrative domain of Gujrat and is being done with the help of Gujrat Police, which itself is in dock.
Whatever the result of SIT's closure report be, but theres non in this world who would not be able to accept that Modi failed to control the riot and did nothing for ten years to promote harmony between the two community.
His temper and mood before the Gujrat riots could be best understood through the CD's of his speeches.
All that we could do is that pray that if he is responsible for all this, the law of land and justice prevail .

Now picture is complete cleared about Narendra Modi. Modi is not guilty, he was targetted by Congress, so-called media & so-called activists & NGOs since last 10 years. But I know still they will not stop their campaign against Modi. Because some get political advantages from this campaign, some get money advantages and some get false joy & satisfaction by this campaign.
Modi should become PM of India. On that day, new sunrise will happen in India. I hope for that day. May God bless him to fight against evils.
The SIT report takes cognisance of facts supporting Mr. Modi and rejects all facts which were produced before them by Mr. Bhatt and Mr. Ramchandaran going as far as indicting Mr. Bhatt of forging faxes and telling lies. It is obvious that the SIT had an ax to grind. They wanted to clear Mr. Modi of any wrong doing of the gruesome pogrom he visited on the Muslims of Gujarat. It is also obvious that the SIT had decided beforehand that Mr. Modi had to be exonerated at any cost.
The more the logical conclusion in Godhra trial is hard to reach, the more the people may tend to lose faith in the process of law. That the road to justice is labyrinthine does little justification to the families of the victims. Let us for the sake of argument,brush aside the alleged motive behind the report of the amicus curiae and the earlier statement of Sanjiv Bhatt. The M.K.Tanden. P.B.Gondia, the two Commissioners of Police were not spotted on the venue of crime. What made them leave Naroda? What was the role of two ministers of Gujarat in averting the gory murder despite their very presence as revealed in all investigations? Was the Chief Minister too engaged to miss the heat? The truth behind all the above surmises, converges on one point.And that is the total paralysis of the state machinery of Gujarat. Who has the Sadhbavana to own the accountability? Scratch one's conscience.
A veritable cottage industry appears to have grown up with the sole objective of discrediting Narendra Modi if not bring him down. His success in running a government that can deliver should be model for other states and the Centre.
By the way, can people who fabricate and forge evidence be allowed to go without punishment?
So Mr Modi actually did NOT say the now infamous "every action has a reaction" comment (in regards to Gujarat riots)- repeated ad nauseum by every newspaper/channels almost every day for the last 10 years? In fact the above comment was a fabrication by "Times Of India" for which they have been forced to apologize??!! WOW!! Our media is truly partisan and nobody brought these facts to public except The Hindu!! I am truly astonished by the non professionalism and bad ethics of Indian media. Well done Hindu, you are truly a shining star in the dark cloud of Indian media scene!!
Thanks to The Hindu for bringing out this side of the story. Mr Modi is bringing Gujarat to be a better place to live and that is commendable. But this issue has been taking up so much attention that people fail to notice the good things done by him to strengthen the state. And hope Mr Bhatt will be punished as if he did fake the messages etc, that indirectly is creating a wrong message to the public that Mr. Modi acted against communal harmony. That creates more hatred among people.
Mr.Bhatt-can he forge the fax himself?

the matter must be fully investigated.
Admitted that there was a conspiracy against Modi and all the evidence submitted to prove his complicity were fabricated, forged and that the various documents that showed Modi playing an active role in the massacre are “false and fabricated documents”, the decision to bring the bodies of the victims of the Godhra train carnage to Ahmedabad, were not “dereliction of duty” on the part of the Chief Minister, his Cabinet colleagues and the senior police officers. No fax messages ever existed and were concocted by Mr. Bhatt at a much later stage and the signatures of his superior officers forged. There was no indication that the police were given any instruction from the higher-ups not to act and to leave the affected areas to the mercy of the riotous mobs. There was nothing to show that Mr. Modi had ordered the “handing over” of the bodies to Mr. Patel. Will the SIT ultimately challenge the amicus curiae to prove that the massacre ever took place and that 2000 people were ever killed?
