Military Intelligence paid hundreds of crores of rupees for outdated software, documents obtained by “The Hindu” show
The Indian Army's imagery interpretation capabilities, critical to providing information on the locations of enemy troops and their military assets, have been compromised by flawed contracts placed with a company that has failed to provide critical software upgrades, an investigation by The Hindu has found.
Documents obtained by The Hindu from the Ministry of Defence show that the firm responsible for supplying and integrating software used in critical image intelligence analysis was relieved of its responsibility to provide free upgrades in 2008 — and is now on the verge of receiving a Rs.165-crore contract for the supply of software it may no longer have licensing rights for.
MI17 — the super-secret military intelligence department that analyses data provided by India's spy satellites — relies on software provided by global software giants Intergraph, Oracle, and Bentley.
Rolta, an Indian company, supplied photogrammetry and geographical information system software licensed from these firms to the Army in 1996, integrating them into a single package to meet MI17's specific needs. From then to 2008, things went well — when a new contract for 14 photogrammetry and geographical information system packages came up to be signed.
The earlier contract bound Rolta to provide software “updates and upgrades” free of cost, as part of a maintenance contract. In 2008, though, the phrasing was changed to just “updates”— freeing Rolta of the obligation to provide the most recent software released by the original equipment manufacturer.
Rolta was paid Rs.506.45 crore for equipment purchased between 1998 and 2008. In addition, it received annual maintenance contracts for equipment purchased during this period; as of December 2008, their cumulative value was Rs. 40.66 crore per annum.
But by early this year, highly-placed military sources said, MI17's image-processing speeds had fallen to just a seventh of those being obtained by the National Technical Research Organisation, which also analyses the same data using similar software with the latest upgrades, Intergraph-Erdas.
Dubious negotiations
The records of the contract negotiation committee, or CNC, show a series of questionable decisions led to this outcome. In the fourth meeting of the CNC, one member noted that an odd change had been made to the name of the software being supplied to MI17: “the vendor,” he observed, “had added [the] company name ‘Rolta' in all the software being provided by him.” The change of name implied that the equipment being supplied was not the same as was purchased in 1996, which would have necessitated fresh acquisition procedures to be initiated.
Atul Tayal, Rolta's representative, responded in the fifth meeting of the CNC that only the brand name was changing — not the equipment itself. During Rolta's “association with the Indian Armed Forces over more than one decade,” he said, “the company had developed a number of customised modules specifically designed to address the needs of the Military Intelligence Directorate.”
“These customised modules,” he wrote, “are integrated with the basic equipment and supplied to the user. Due to this the company has decided to supply these equipments [sic.] under the brand name of Rolta India Limited after the necessary approval of M/S Intergraph, USA, and other parties.”
The CNC guarded its flanks, the minutes of its fourth meeting show, with its chairman insisting that “a certificate from the vendor be obtained certifying that software offered in the present and previous contract are the same.” It was further directed, the minutes record, “that adequate provisions will be made in the contract to confirm the fact at PDI [pre-delivery inspection] and ATP [acceptance test procedures] stage.”
In a September 2010 letter, Rolta certified it would “have full guarantee and warranty from Intergraph Corporation with respect to the goods sourced from them for IIT [imagery interpretation team] equipment under replacement.” The certificate was signed by Brigadier Anjum Shahab, the Regional Director of Defence Sales for Rolta – and the same individual who, as Deputy Director General of Military Intelligence in 2008, served on the controversial CNC.
The actual “full guarantee and warranty” from Intergraph was never provided, for the simple reason that the 2008 contract did not call on Rolta to hand it over. From other documents, however, it seems apparent that no such guarantee actually exists. In a letter to the Defence Secretary, written on July 8, 2011, Intergraph said it had “reliably learnt from a number of Ministry of Defence officers that the Indian Army may have been supplied Intergraph GIS software under a different name.”
It asserted that Intergraph had at no point authorised anyone “to customise any of the products and/or to sell the Products under the name and/or branding of the Distributor or any other company.” Put simply, that meant Rolta had no rights to license Intergraph software to the Army — and that Intergraph would not, therefore, supply the periodic upgrades that came with the package.
Nonetheless, the Indian Army is now firming up plans to purchase another Rs.165 crore worth of equipment from Rolta. MI17 sources said no fresh procurement procedure will have to be carried out because the vendor continues to be Rolta — even though its elements are likely to be assembled from modules supplied by a Canada-based software company, PCI Geomatics.
More than half the cost of the new order, sources said, is made up of software giving capabilities that MI17 would have had anyway, if upgrades had been obtained since 2008. Documents available with The Hindu also reveal that the Planning Officer of the Directorate of Planning and Coordination, Department of Defence Procurement, had written a letter on November 17, 2009, recommending that fresh “equipment may be procured through competitive bidding.”
Indian Army officials declined to discuss the contract on record, or to discuss specifics. However, a high military official who briefed The Hindu on condition of anonymity said that while he was aware of complaints about Rolta, they were “being made to malign the operational efficiency of the Army.” He noted that Rolta was not obligated to give upgrades, but did not explain why the 2008 contract, and subsequent ones, had relieved it of its earlier obligation to provide them. For its part, Rolta also pointed out that it had met its contractual obligations. In an e-mail to The Hindu, Rolta said it had “provided all deliverables it has been contracted to under various agreements with MoD.” In response to a question on whether they had permission to supply Intergraph software, Rolta said the equipment it had supplied was delivered “in line with their respective end-user licences.” Mr. Atul Tayal told The Hindu that the allegations “are absolutely baseless and seem to have been made with mala fide and motivated”.

At first place it is defamatory to call a contract a dubious one without knowing the facts.Contract is between the vendor & the customer.When Defence is the costumer the contract is finalized after going through laid down procedures.For the last 10 yrs since 1996 Rolta supplied softwares in IIT have been utilized to iterpret Satellite imageries not only for terrain interpretation which is a peace time & an ongoing task but also for detecting troop moment.I being an interpreter have provided important inputs of tps move to ops room during warlike situation . let me tell you without effecient imagery interpretation system, operational planners are blind men groping in darkness.The effeciency of Rolta softwares has already been proved during hotwar like situation.Even a layman can look at an imagery but it is just a photo for him. Interpretation of image depends only on the military knowledge of an interpreter.The software helps the interpreter to arrive at precise conclusions.
I am reading through these comments its very surprising that employee's of the accused company trying to infuse very high regard for the claimed dubious contracts. I suggest employees of Rolta should maintain bit of intigrity and stop writing 'self positive' comments into this column. Anything of that nature will not help their case. Incase if Rolta thinks they need to respond through this column, it would be fair to state that they work for Rolta.
The free press is important for the function of the democracy. What The Hindu is doing is helping to improve the security of the nation by publishing the mismanagement in the procurement of defense articles but also weaknesses in protecting the classified information. Strong security measures are important not only to protect the nation but also to give confidence to the foreign investor that their investments are safe, which in turn will alleviate the poverty in the country.
As usual our defence minister will come out untainted.But he should go deep down to the issue and surface the real culprit.We have faith in you.

team of a strike Division having vast imagery interpretation
experience for operational planning even in war like situation.Let me
tell one & all, at no stage the capability/effeciency of IIT for
providing neccessary information for operational planning has been
compromised due to the lack of effeciency of Rolta India Ltd software.
As OC IIT, my interpretation work changed the entire course of op
planning.How stupid to compare 10yrs old eqipment with NTRO equipment
acquired 3yrs back.Speed of opening image depends on processor
speed.Army also now uses sub mtr resolution requiring highend
processors.The angrez sitting abroad can not comprehend after sale
services reqired for army which Rolta does whose services are just a
call away. HP whose plotters are used in IIT has failed to do so. Be
it desert or High altitude Rolta service is prompt & efficient
Defence Minister should come clean on this issue
well there is no secret about the organisations mentioned here and what they do.so i dont understand how "national security" is compromised. There is nothing classified here. But i wonder how hindu got hold of the letters. If we hide behind classification then other defence expose would not happened. Its a duty of every citizen to expose the rotten and bring out truth. I think some people dont seem to know how we begin and how they should continue.In the NCC we started out with .303 rifles and we learnt to hold and take the kickback of the rifle and fire.Thats about 40 years back.AK-47s were available then.The country should use whatever is apt and at all places we dont require sophisticated equipment.If we were to equip special protective force for VIPs we would expect that they are having the latest and probably the most suited for the personnel.Some of the combatants will show you that it the person who handles it which counts and the latest equipment in the wrong hands is a disaster like the security personnel who shot Prime Minister Madame Indira Gandhi.

Seems to be that this is a big deal out of nothing. I think nowadays everyone wants to uncover a better scandal. The Government should realize that software upgrades cannot come for free that too based on a contract from 1996! To do quality work you need to be willing to cough up the money it takes to maintain and upgrade software and equipment and not kill the vendor with onerous clauses. I guess it is ok for someone to siphon the money to their Swiss accounts but not ok to pay for software upgrades. It should come for free for ever!

by Indian army officials. The Lokpal bill must have a stricter
punishment for people involved in scams in Indian Army that endanger
India's national security. I hope that Indian IT sector professionals
could develop image processing software of the satellites.
In another revelation coming out firstly it’s been an appealing job done by The Hindu. Though it sounds very scary first and unravel lot of untold stories its pragmatic that when our bureaucrats hands of our system who drive and our political heroes who are faces are very hectic in stashing taxpayers money in safe heavens. 500 Cr for image analysis software is utter nonsense. Is it really true that India cannot develop image analysis software? People who are procuring them are ignorant and do not have the know-how to use the domestic talent.
If the ministry of defense has let out this information,I would think
that it is some fake information. Which country in world would publicize
such vital secret information to the entire world to know ?.Is everyone
in the ministry and the government so naive to hand over such documents
to the media knowing fully well that there is ample material in it which
could set a blaze against it ?The ministry would have denied access to
the information under the pretext of security concerns, if there is any
truth in the expose.
It was OK to purchase Defence Equipment during the Cold War as the
erstwhile USSR,supplied them at a very cheap rate[Thank You, USSR!].But
now India needs indigenization lest all the money be swallowed by the
USA and Israel.India also needs to build Civilian Airliners.

justified to feel wronged, but tell me, how would you know if it was

I congratulate Hindu for bringing the story. It really shocking how a Sr defence official recommend something for a particular contract in favour of a company and then join that company in sales. I do have high regard for Defence Minister, he should immediately summon all concerned. Rolta being earlier distributor of Intergraph and now of PCI Geomedica is tweaking contract software name in their favour, that's really against business ethics. And any person involve in software industry know details about software update and upgrade difference. Regarding Indian software producing 'Indian' software, well indian software industry is into service business not into manufacturing software business. We event didn't tried Chinese model of cloning software,so no point of creeping about it. It's very unfortunate for a news paper of such high standard to publish new article which looks a bit biased. It seems that the news has been deliberately circulated by rival companies who has missed out on many occasions. The equipment and Software provided by Rolta is world class and it certainly fulfills the daily need of the Armed forces. If people thinks that by simple upgrades I can enhanced the performances of an equipment is very foolish on their part. Here we are talking about an equipment which is a decade old. Now a days technology changes every day and we have keep pace with it. Even in developed countries like America there is private and Govt partnership for all defense and development programs.

It seems that article has been written, with biased attitude. Though it has been tried to put a lot of evidence to support his statement, still it seems that news maker is biased to criticize some officials. Now a days, it is very popular trend in media to target some top level official and do a postmortem of their decision. Army's decision are good example of it. Almost every decision taken by defense services is being dragged in to media trial. This is not a good trend. Indian defense services have worked excellently without interfering of external forces. Defense services are still reliable and media should avoid to raise finger without any solid reasons. It can be understand in other ways too, Like other field, Media itself too is very competitive in these days.

As of I know, there is a long process of procuring a software or any equipment from a vender. Number of venders invited, Series of test performed which is called technical evaluation and then who qualify the TEC eligible for financial bidding, so to call “Indian Army blinded by controversial equipment” is seems to be wrong and funny. This article is also disclosing the name of the software that is being used by Indian army's Intelligence wing is really unfortunate. I would say it is not a wise move to publish a confidential and vital information so flawlessly is discouraging and threat to our national security. To disclose the name of an institution like NTRO which is operating in the country for security interest is really disgusting and showing the immature step taken by such an highest pride national news paper.

Apart from triggering a debate on whether is appropriate to publish this kind of news or not, it insinuated that Contract Negotiation Committee has been fooled by Software licenses. I'm afraid that our military is not being managed well and feeling so sad learning that millions of public money is being wasted on non-reliable equipment.
I'm outraged by this kind of activities going on in our defense. I really appreciate our TheHindu for getting this critical news. For this kind of activity the investigation should be done from the inside of the defense on what made Brigadier Anjum Shahab to have worked in the CNC and later take up position as Regional Director of Defence Sales from a vendor. There is a lot of detail is missing on this to understand the complete inside. 1, Brigadier Anjum should be summoned to respond on justifying his acts. 2, How he justifies should be measured against what risk does our defense personnel would be going through if our intelligence is compromised (Imagine the situation as of Nov 26th); 3, I don't believe how Anjum even became a Brigadier into the office with this kind of knowledge and leadership;.

I feel this is a classified document;Should not be published in newspapers.The Hindu has done a good job. But this kind of military secrets should be confined to the concerned ministry and CBI.
It is really shocking to know the things are managed in one of the vital institutions of the country. But citizens of India must know that it is the same way purchases are made in the majority of the government offices. Mostly substandard materials in the name of lowest quotations or outdated equipments. If quality ones are purchased the price is always jacked upto the level of MRP or even beyond that. Its disappointing that national interest are being compromised for personal and monetary gains.The crucial departments like defense should have more reliance on Government sector for its needs and requirements.And the Government needs to upgrade its ordinance factories and depots for efficient supply for arms and other requirements.
Will the Prime Minister now sack the Defence Minister so that the media can absolve his government of charges of corruption? But here there is a problem. Mr.Anthony is a Congress leader and has a reputation for honesty. Interesting times are ahead, that is for sure.
It is time India puts her scientists to work on serious R&D by paying them well and providing with state of the art laboratories. If Government can't finance and manage it, give the job to private companies of high security clearance. Indian brains could also express and flourish in Indian soil if one makes it fertile! It is routine the world-over for companies to customise software products and sell them to customers. Intergraph stating that it has 'not authorised' someone to customise the product makes no sense. However, when customisation is done, the end-customer has to pay annual license fees in case they want annual upgrades to the software. Is it the case, in this instance, that the army was not paying annual maintenance to Intergraph either directly or through Rolta?
Hitherto it was thought that the Ministry of Defence under Anthony was the only one which was totally above board,particularly in matters of Defense Purchases.It now seems that that Department too had decided to vie with other ministries like IT/Telecom etc. by indulging in scams of small order for starters.And to think that this has been going on from 2008.The Minister must have been euphoric under the influence.Now emboldened by the success(?) of their initial attempts the Officers of the Department must have ganged up to try their hand at increasing the stakes in the game albeit by still only a small amount by standards set by Raja. The sun has not even set on the Mega Scams released in the recent past by Raja,Kalmadi,Chavan etc.Now Anthony (?) and Company are already getting set in their serious attempts to beat the earlier figures and create the Grand Daddy of all scams.More Power to them. Finally, Indian defence companies are catching up with their American counterparts in the art of stealing taxpayers' money.
