Moves court for summoning CBI official to testify
Janata Party president Subramanian Swamy on Thursday told a special court, hearing his private complaint, that he had fresh evidence indicating that the former Telecom and Finance Ministers, A. Raja and P. Chidambaram, were jointly responsible for deciding the 2G spectrum pricing and the UAS licence entry fee.
Dr. Swamy moved an application seeking that he be recalled as a complainant to depose further and sought the summoning of officials, including a person from the office of the CBI Joint Director, to record their testimony “in the interest of justice.”
“The fact that the two Ministers together decided that the prices of spectrum and the entry fee should be lumped together at the 2001 level and decided against the market price of the 2007-08 period for the entry fee is confirmed by the speech of the Prime Minister in the Rajya Sabha on February 24, 2011,” Dr. Swamy's application said.
The application, filed under Section 311 of the Criminal Procedure Code for summoning of witnesses, also alleged that there were records in Dr. Swamy and the CBI's possession which suggested that “despite the impression created that the Ministry of Finance was opposed to the fixation of price at the level of 2001, Mr. Chidambaram entered into a discussion with the accused, A. Raja, to jointly determine the spectrum price.”
Dr. Swamy said he had established “some communication” with the CBI through which “some new facts have emerged.” To prove the “communication,” the official concerned from the office of the CBI Joint Director should be summoned.
The matter is listed for hearing by Special Judge O. P. Saini on September 26.

it is not surprising CBI do not want to investigate against Mr. P.Chidambaram since CBI works under him. In all fairness CBI charge should be directly under Mr. Manmohan Singh who is the only honest person in the cabinet. Chidambaram and Kapil Sibal, both lawyers - liars - are two blacksheep in the cabinet who defend 2G swindlers.
@K.Vijayakumar: Is corruption only about personal benefit ? How about a minister benefiting his friends and family (called nepotism). How about giving contracts to companies whose bosses are your friends or give huge donations to your company or have family relations. Stopping CBI from questioning Chidambaram makes it very clear, the involvement of Chidambaram, PM and Sonia (top congress officials) in the 2G scam.
I agree with Mr. K Vijayakumar.. dragging the most efficient FM and Home Minister of Modern India into this issue is nothing but cheap politics.. India needs a fearless and upright person like Mr. Chidambaram..
Dr Swamy is a proven litigant for public cause. He did it with R> Hegde and Jayalalitha. He hampered the DMK and Balu s hidden self profiting motives in the Ramsethu case. He claims not only merit benefit of doubt but more as someone who says right things and thinks right. The very fact that no one from Sonia through PC to Raja dare to sue him in defamation when he openly specifies the amount of kick back each one of them benefited is by itself an act of admittance of corrupt practices by the alleged culprits. What the coward detractors do are indirect threats to cancel the affiliation of his party or to try to damage his name at his work or to vandalize his house in his absence. Unlike CBI judges are not at the mercy of the government and are intelligent enough to let Dr Swamy to prove his claims. I wish Dr Swamy all success. Defining policy with ulterior motives is not corruption but connivance to corrupt practices. This is pre-meditation so punishable under law.
Since the time Mr Chidambaram joined the Central Govt, he has been surrounded by many controversies & allegations. He was linked to the Fairgrowth company during the time when Harshad Mehta was involved in the shares scam. Thereafter there were allegations against him in the Indian Bank scam. His election to the present Lok Sabha has also invited serious charges of manipulation against him. So, the public in general hold a view that he is not a clean politician. Under these circumstances, it is high time that he demits office and clear his name over his alleged involvement in the 2G scam. It is for sure that other central ministers/ministries were also involved in the spectrum allotment and so it is not logically & legally right to punish only Mr A Raja or Ms Kanimozhi or Mr Maran. Mr Chidambaram is under the cloud and so the contention of CBI & the Govt must not be accepted by the highest Court of the land. If it happens, it will be a mockery of the judicial system.
If a minister by himself or along with other concerned ministers takes a policy decision which has resulted in financial losses for the government,it cannot be automatically branded as an act of corruption unless it is proved that personal gains were made by the minister or ministers out of the decision. One has not heard of any confirmed evidence of A.Raja or any other minister personally benefitting from the 2G spectrum allocation even though there are many accusations floating around.. However this is not to say that no corruption was involved in the allocation, but only to point out that the CBI is apparently talking in the air. Has Mr.Swamy any real evidence in this regard? If the evidence he has gathered is not confirming any money trail that benefitted the accused, such evidence may not have any legal significance. It can only make an exciting media story.
It seems Swamy has diligently collected all the evidence pertaining to each & every transaction concerning 2G. It is highly inconceivable that RAJA alone was the ARCHITECT behind the SCAM OF THE CENTURY. If it was so why was it that the PM was defending RAJA till the last? Like Swamy claims in the court & in many public speeches, the 2G scam was planned, perpetrated by the people on the top. Swamy, in several interviews & public speeches claim that right from Sonia Gandhi to Raja - all were beneficiaries of the scam. Swamy also quotes the amounts each one received as KICK BACK. CBI's{UNDER PM} reluctance to even conduct a FAIR INVESTIGATION, the undue haste shown by PM & Chidambaram in pushing Thomas for the position of Thomas all point to the unmistakable theory of involvement of these top people.
SC should take SUO MOTO action on this case & allow SWAMI to act as a PUBLIC PROSECUTOR. Otherwise RULE OF LAW will be meaningless.
Why the Court is not summoning the Union Ministers inspite of several requests with evidence from different quarters? Is the court also afraid of rattling Congress now?
If Subramanian Swamy is able to prove Chidambaram's involvement in the 2G scam, it would be a great achievement. I hope he pursues the matter to the last drop of his energy.
