The Central Bureau of Investigation (CBI) has appealed to a special court here to dismiss the bail petition of Y.S. Jaganmohan Reddy, the first accused in the disproportionate assets case, stating that it is contemptuous in nature.
Arguing against the bail petition of Jagan on Friday, counsel for CBI B. Ravindranath contended that the petition was not maintainable in law and was liable to be dismissed in limine since the Supreme Court, while dismissing a bail petition of the accused, had observed that he could seek bail only after completion of the investigation in seven distinct offences.
Article 141 cited
The CBI counsel also cited Article 141 of the Constitution and stated that the orders of the Supreme Court shall be binding on all courts in the country. He argued that the petitioner could not give a different interpretation of the apex court order and his plea for bail was not maintainable.
Further, Mr. Ravindranath explained that the CBI had filed four charge sheets in distinct offences and the investigation in seven other offences related to Sandur Power, Bharathi/Raghuram Cements, Penna Cements/Group, Dalmia Cements, suitcase companies ‘based’ in Kolkata and Mumbai and Indu Projects/Lepakshi Knowledge Hub was in progress. The CBI would file a single charge sheet for the seven offences without any undue delay.

Submitting the grounds for Jagan’s bail, senior counsel C. Padmanabha Reddy and others contended that their client was eligible for enlargement as the CBI had failed to file the charge sheet with regard to the seven distinct offences referred to by the Supreme Court even after the stipulated 90-day period.
They stated that the Andhra Pradesh High Court, while dealing Jagan’s bail petition in the past, had observed that the accused was deemed to have been arrested in all distinct offences under investigation along with the Vanpic case under which he was arrested.
After hearing both sides, Judge U. Durga Prasada Rao reserved his orders for November 28.
He also posted the hearing in another bail petition moved by Jagan with regard to the cases in which charge sheets were already filed to the same date.
