CBI wants accused to appear in court

A Delhi court on Thursday refused to initiate proceedings to declare Malaysian nationals T. Ananda Krishnan and Augustus Ralph Marshall absconders in the Aircel-Maxis deal case.

The CBI filed an application seeking initiation of the proceedings against the two, arguing that the accused could not be discharged midway without first submitting to the jurisdiction of this court. Therefore, a proclamation may be issued under Section 82 of the Code of Criminal Procedure for their appearance before the court.

Special Judge O.P. Saini also adjourned sine die the case against the two accused against whom arrest warrants are pending.

While issuing the arrest warrants against the two accused last year, the court had ordered that the trial against them and two Malaysia-based firms, Astro All Asia Network PLC and Maxis Communication Berhad, be segregated from that of the other accused.

Marans discharged

The court had in February this year discharged former Telecom Minister Dayanidhi Maran, his brother Kalanithi Maran and others in corruption as well in money laundering cases, saying there was no sufficient evidence on record to frame charges against them. The Enforcement Directorate filed a complaint under the Prevention of Money Laundering Act against them on the basis of the CBI charges.
