The Delhi High Court on Tuesday asked Janata Party president Subramanian Swamy to apprise it of the relevant laws and judgments in support of his contention that Prime Minister Manmohan Singh should grant sanction for the prosecution of Communications Minister A. Raja for his alleged involvement in the 2G spectrum allotment scam.
A Division Bench of the court comprising Justice Madan B. Lokur and Justice Mukta Gupta passed the direction while hearing a petition by Dr. Swamy seeking a direction to Dr. Singh to take a decision on his complaint pending with him in this regard.
The Bench asked Dr. Swamy to show it, on the basis of the authority of law, whethersanction for prosecution could be granted against a public servant merely on the basis of evidence placed by a private person and without an investigation by an investigating agency.
Dr. Swamy also referred to a letter written by the Prime Minister's Office to him which said that the Prime Minister had refused to decide on his complaint as the CBI had registered a case against unknown persons in the scam case and investigation was still going on.
The matter will now come up for hearing on May 18.
