The Supreme Court on Thursday confirmed the death sentence awarded to Yakub Abdul Razak Memon, the main accused (A-1), and brother of Tiger Memon (the mastermind and absconding key conspirator), holding him guilty of being the “driving spirit” in the 1993 Mumbai serial blasts that killed 257 people.
The court also upheld the conviction of actor Sanjay Dutt in the case, but reduced to five years the six-year jail term awarded to him by a designated TADA court in 2006 for illegal possession a 9 mm pistol and an AK-56 rifle, which was part of the consignment of weapons and explosives brought for the serial blasts. The apex court ruled out his release on probation because the “nature” of his offence was “serious.” Mr. Dutt (53), son of Bollywood couple late Sunil Dutt and Nargis, had spent one-and-half years in jail and was out on bail.
A Bench of Justices P. Sathasivam and B.S. Chauhan, however, commuted the death sentence awarded to 10 persons by the TADA court, into life imprisonment till their death. These appellants parked explosive-filled vehicles in the respective destinations.
Making it clear that the sentence would be subject to the power of remission, the Bench said the executive should give due consideration to judicial reasoning before it exercised the remission power.
The Bench maintained that Pakistan had a major part in the blasts. “A careful reading of the confessional statements of the convicted accused exposes that a large number of the accused, including the absconders, received training in [the] making of bombs by using RDX and other explosives” in Pakistan, it said.
Writing the judgment, Justice Sathasivam said: “The confessional statements of various co-accused make a mention that Tiger Memon, the mastermind of the whole conspiracy, instructed the other appellants to stay in touch with A-1 for further instruction. … A-1 assumed the role of Tiger Memon in India during his absence. As an outcome, Tiger Memon gave the commands to A-1, who in turn passed them on to the other accused… Essentially, A-1’s deeds can’t be viewed distinct from the act of Tiger Memon, hence both owe an equivalent responsibility for the blasts. They were the architects of the blasts, without whom the plan would have never seen the daylight.”
The Bench said:
“From this conduct, it is not a hyperbole to state that he was one of the ‘driving spirit’ behind the plan…, whereas the other appellants played a far lesser role and thus [made] a lesser contribution to the crimes resulting from this plan. To be clearer on the dominant position, the blasts on March 12, 1993, was at the discretion of the masterminds, meaning… they had the effective control over the incident.
“It is this effective control… which is absent in the role played by the rest of the appellants. It is difficult to rule out with certainty that if the absconding accused were to be brought to trial, they might have thrown further light on the role played by A-1. If we say it in a metaphoric style, A-1 and all the absconding accused were the archers, whereas the rest of the appellants were the arrows in their hands.
“Taking into account… the totality of A-1’s culpability and all the particular circumstances of the case, we concur with the decision of the designated court and confirm the sentence of capital punishment [awarded] to A-1.”
The Bench upheld the life sentence awarded to 23 others, including police and Customs officers; Yakub Memon’s brother Essa Memon who was found guilty of conspiracy and allowing the use of his flat at Al-Hussaini building at Mahim for meetings to plan the blasts and storing arms and ammunition; and Yakub’s sister-in-law Rubina Memon, who arranged finances through her bank account and allowed her car to be used by terrorists for carrying co-conspirators, arms, ammunition and explosives.

In any issue of any newspaper in which anything is reported about the Italian marines, there is, ironically appearing alongside it, abundant evidence of why Italy and the whole world regards the Indian justice system as a mockery. Who really believes that Sanjay Dutt is going to spend three and a half years, or even one year, or even one month, in jail? In fact, how many Indians even want that, or even understand why it should happen?
Sanjay Dutt has been made the scapegoat here. While he is guilty of possessing a
prohibited weapon he has been acquitted of the charges of terrorism and conspiracy.
This punishment to Sanjay Dutt, is to give common man a false sense that justice has
prevailed. The more disturbing fact is that this is being perceived as giving those
affected by the blasts, a false sense of closure. I am not commenting on whether
Sanjay Dutt deserves his punishment or not. I am just annoyed at how his sentence is
being portrayed as victory against the terrorists who schemed and executed the
1993 Mumbal blasts.
India needs to carry out these sentences quickly and press heavily for the extradition of Dawood Ibrahim from Pakistan, if need be via the UN or ICC courts. Pakistan being a rogue state that supports terror also must be highlighted to the international community.
It seems people of this nation are nobody. Tomorrow if we die, our
next generation will grow older then the decision would come finally,
and they will search for the convicts, because half of them are
already dead & rest absconding. Innocents die and our judiciary takes
this huge amount of time to atleast punish them. Why have my
honourable government made lower courts when its decisions can be
challenged at any point of time. Also, our memory is same, as of,
Aamir Khan's in Ghajini, we forgot when our beloved Sanjay Dutt got
bail, watched his 9-10 movies, enjoyed and now we recall he did
something so he should be behind bars. Our system has crashed like, in
Computer, Windows gets corrupted. Now you again will do 'Ohh', How
many of my noble citizens remembers Kalmadi is on bail and so far 3
months have passed and still no hearing. Cheers!

Its,very unfortunate that accused of 1992-93 mumbai riots were not punished and Justice B.S.Srikrishna report was not implemented.
Why should Dutt be given special treatment?Everybody has to respect law.He should have been given tougher punishment.

taken against them and how are we setting standards? Are they still in
job enjoying the taxpayer money as salary for acting against taxpayers?
It took 20 long years for the courts to deliver justice. Must be near the world record for such serious offenses. The Human Rights activists, and others (the same people who remain silent when terrorists kill innocent people) will again be speaking loudly in favour of those convicted. The SC has also confirmed the involvement of Pakistan which was also involved in the subsequent attack on Mumbai, the attack on the country's Parliament etc etc.
Its not clear whether Sanjay was convicted for involvement in 1993 blas
case or also for possessing AK 47.
At last justice has prevailed, its historic day for the India and
judiciary system that the trial has finally come to its conclusion and
the perpetrators have been brought to book. Many of us question the
time taken in delivering the verdict and argue that is this the real
justice? Is this justice to the victims of blast? Could not it have
been expedited? Will it really restore the common man's faith in
judiciary and instill fear in the minds of criminal? We all have
witnessed the sluggish pace of the system whether its Mumbai blast
case or parliament attack case. Lot of efforts have been taken to fast
track the cases but still a long way to go.
Though the perpetrator have been sent to the jail and even he
celebrity like Sanjay Dutt was not speared , still the kingpins are at
large and efforts have to be made to in order to nab them.
In the age of sensational breaking news, The Hindu shows remarkable

Finally the apex court has convey to the society that no body is greater
or less in terms of functionality of the constitution.I truly believe
that Our country is solely controlled by the Apex Court(given the
present scenario where the entire nation is slammed with scam,injustice
etc.).The apex court has clearly set an example through upholding the
sentence of Sanjay Dutt that no identity is bigger when it comes to
abiding the law and threat to the nation.
