Three persons acquitted

A Sessions Court here has acquitted three persons who were cited as accused in connection with causing a minor explosion at Chalakkara in Mahe.

On May,13, 2009, three persons detonated country made explosives at Sree Narayana Madam Road, near St. Theresa High School, Chalakkara. Rijoy (23) and Sarath. K(23) of Chalakkara were arrested in a few days while B. Shanil alia Jiju (25), surrendered a year later.

In the charge sheet, the Station House Officer, Palloor Police Station, Mahe said the trio caused the explosion to create panic in the minds of Congress party cadre and said the accused committed the offence punishable under section 3 of Explosive Substance Act, 1908 read with 34 Indian Penal Code.

Originally the case was taken on file by the Judicial Magistrate, Mahe as PRC. No.9/2011 and after furnishing the copies to the accused and as the offence was triable by the Court of Sessions, the case was committed to the Court of Principal Sessions Judge. At the conclusion of trial, II Additional Sessions Judge T.S.Nanda Kumar held that the prosecution miserably failed to establish the case against the accused.

Finding that the accused were not guilty, Mr. Nanda Kumar also said, “the evidence given by the official witnesses is not of much help. Furthermore, the prosecution has not proved that the offence is committed in furtherance of common intention.

Since no incriminating evidence has been adumbrated by the prosecution as against the accused arrayed in this case, this court is inclined to acquit them.”
