‘Government lethargic in implementing Central Acts’

Puducherry Government has not framed rules for enforcement of laws

The Puducherry government is yet to implement a few important laws which were enacted by the Centre several years ago.

An Act is an official copy of a statute presented in the form of a Bill and after discussion and incorporation of suggestion, such Bill was passed by Parliament. The central and State governments should frame rules or guidelines for the implementation of the Act.

The Communist Party of India unit secretary R. Viswanathan said: “On many occasions, the government stopped with the publication of Central Act and rules framed under. But it did not come forward to frame its own rules for better implementation of the Act.”

The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, the Right of Children to Free and Compulsory Education Act or the Right to Education Act, 2009, The Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act and a few other laws relating to local administration were enacted by the Centre. But the UT administration has not come up with its own rules.

Mr. Viswanathan said: “Since no rules have been framed for the central Act — the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2014, the government was not able to acquire the land for construction of houses for the poor and for other infrastructure. Nearly five years ago, a site selection committee decided to acquire 26 acres of land at Karuvadikuppam for setting up permanent infrastructure facilities for a Coast Guard Station. The land was not acquired by the authorities concerned because rules have not been framed for implementing the Central Act.”

Similarly, a few other laws relating to civic authorities have not come into force as rules were not framed.

A top official said, the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act was enacted by the Centre a few years ago. But the Puducherry government was yet to frame the rules for implementation. There should be political will to strictly implement the laws.

“A State vendor committee should be constituted before implementation of law and rules should be framed by the government immediately. Neither the committee has been constituted nor the rules framed for implementation of the Act,” said R. Rajangam, Puducherry secretary of Communist Party of India (Marxist).
