Woman’s rape plaint against husband, relatives false: cops

Navi Mumbai Police file closure report in case, claim complainant is trying to save extramarital affair

Mumbai: The Navi Mumbai Police’s investigation into a complainant’s allegation of rape by her husband while his brothers were present has shown the woman lied to the police. Accordingly, a B-summary (closure) report has been filed in the case by the APMC police station, which claimed the complainant filed false charges to prevent her husband from interfering in her extramarital affair.

PI Prafulla Bhingarde, APMC police station, said, “The report has been forwarded to DCP (Zone I) Sudhakar Pathare, after which it will be submitted in court. We’ll take further steps on the court’s direction.”

In her complaint, the woman, a resident of Kopri village, had claimed she was estranged from her 27-year-old husband, a resident of Govandi, since April. She alleged that on June 21, her husband had entered her house in Kopri through the front door, while his brother, aged 24, and male cousin, aged 23, entered via the rear door. She alleged that her brother-in-law held her down while her husband raped her. She said the act was filmed by the cousin using a mobile phone.

Mr. Bhingarde said, “The CCTV footage and call location of the alleged accused do not match the complainant’s version. She has claimed that her husband entered her house at 8 p.m., but CCTV footage shows he crossed Vashi toll naka and headed towards Mumbai at that time. The locations of her brothers-in-law were also not in Navi Mumbai, their mobile location data shows. We haven’t found any evidence of the incident taking place. No video or photos of the incident were found in the accused’s phone.”

Police said the complainant is in an extramarital relationship with another cousin of her husband. The investigation also revealed that her husband has Level-4 tuberculosis, and can succumb to the disease. “Her husband was asked by his doctor to strictly refrain from sexual intercourse, else it could worsen his condition. He used to visit his wife only to meet his daughter, aged three-and-a-half,” Mr. Bhingarde said.
