he brother of Gurgaon-based gangster Sandeep Ghadoli, who was killed in an encounter with the police at a hotel in Mumbai last week, has moved the Bombay High Court seeking an FIR against the Gurgaon police officers who were involved in the encounter. Kuldeep Singh, 43, has alleged that the encounter was part of a “well-planned conspiracy”.

Singh, who filed the petition on Friday, said he had approached the Mumbai police on February 9 with his complaint but that they had so far not registered any crime against the Gurgaon police officers.

Ghadoli, who had over 30 cases registered against him, was at the Hotel Airport Metro in Andheri (East) on February 7 when a Gurgaon police team stormed the hotel and made their way to his room. Singh has contended in his petition that this was part of a murder conspiracy instigated by a rival – one Birender Gujjar – and executed by the police.

He has also alleged that the police knocked him unconscious before shooting him at point-blank range. Though police have claimed they opened fire in retaliation, Singh has called it a fake encounter.

“The firing marks in the room premises also indicate that it is not a case of genuine encounter but it is a staged encounter committed by above named accused police officers of Gurgoan police as part of a as a well-planned conspiracy,” the petition said.

Ghadoli had been acquitted in all but two cases, which are still pending trial, the petition said. Family members had approached the police and the state government in Gurgaon earlier saying they feared Ghadoli might be eliminated in a fake encounter.

Singh claims Mumbai police failed to register an offence against the police officers involved in the encounter because of pressure on them, although he has been told they are still gathering evidence. he matter will be heard on Monday.
