The Bombay High Court on Tuesday refused to stop the release of Rahasya , a commercial film based on a murder mystery. Nupur and Rajesh Talwar, parents of Aarushi Talwar who was found murdered in her house, had moved the court against the film.
The Talwars had claimed that the film was based on the Aarushi case, and would cause prejudice to them.
But the court on Tuesday disposed of their petition and held that the film was not based on the facts of their case. “We are, prima facie , satisfied that there are lot of dissimilarities in the case and the film, and as such, therefore, it cannot be said that the said film is actual depiction of the petitioners’ [Talwars’] case,” the court had said in its interim order passed last year. On Tuesday, a Division Bench of Justices V.M. Kanade and Revati Mohite-Dere reiterated its views.
Justice Kanade said his sister judge had watched the movie.
The film has not yet been released.
The court said the producer and the directorhad filed an affidavit stating that they would carry a disclaimer in the film, which would clearly state that the film was “a work of fiction.”
Aarushi and their house help Hemraj were found murdered at the Talwar residence in Noida near Delhi in May 2008. Nupur and Rajesh Talwar have been convicted for Aarushi’s murder.
