Congress Member of Parliament and Secretary, AICC secretary, Shantaram Naik has said that the ban order imposed by the Goa government on Sri Ram Sene, rightwing Hindu outfit is an order without teeth. Unless the order is followed by a regular order by the Central Government under the Unlawful Activities (Prevention) Act, 1967, it has no powers he said.
Mr. Naik pointed out that the Goa government has issued an order under section 144 of the Criminal Procedure Code but it will last only for two months and with great difficulty, for another six months.
Mr. Naik recalled that Sri Ram Sena chief Pramod Muthalik even threatened to open an office in Goa defying the Goa Government. He criticised Ram Sene for trying to misuse the name of Lord Ram for political gains. He demanded the cancellation of registration of the association.
The Congress Rajya Sabha MP from Goa told The Hindu on Thursday that under section 3 of the, Unlawful Activities (Prevention) Act, if the Central Government is of opinion that any association is, or has become, unlawful association, it may, by notification in the Official Gazette, declare such association to be unlawful, although under the section, no such order will come into force unless a Tribunal constituted for the purpose confirms the order passed by the Central Government.
"Therefore, if Goa Chief Minister is genuinely interested to prevent the Sene and Mr. Muthalik from harming the social fabric of the State, then he should approach the Central Government under the Unlawful Activities legislation and prepare their dossier, which will convince the Home Ministry to pass necessary order which will also be sustained before the Tribunal", said Mr. Naik.
He opined that the Goa government has to prepare a case against Ram Sene with proper documents, including, CDs depicting his speeches in Goa and outside, and demand an immediate order declaring the Ram Sene as unlawful.
Mr. >Naik recalled that Mr. Mutalik was about to be admitted in BJP but sensing the political disadvantage to BJP in Goa during the Lok Sabha 2014 elections , Mr. Parrikar, prevailed upon his party bosses not to admit him.
