Plea to stay TNCA polls dismissed

It had claimed that Justice Lodha panel recommendations were not fulfilled by TNCA

The Madras High Court on Friday dismissed a plea seeking to set aside a notification issued by the Tamil Nadu Cricket Association (TNCA) for conducting elections to the association, scheduled on Saturday.

The First Bench of Chief Justice S.K. Kaul and Justice R. Mahadevan passed the order on a plea moved by S. Srinivason, an erstwhile cricketer who played for Tamil Nadu and Indian Railways between 1982 and 92.

The petitioner wanted the court to pass an interim injunction restraining Board of Control for Cricket in India (BCCI) and the TNCA from conducting the proposed elections on June 25, until the final disposal of the petition.

He prayed for the injunction on the ground that the Justice R.M. Lodha Committee’s recommendation on restructuring State cricket associations had not been fulfilled by the TNCA.

When the plea came up for hearing, the Bench, pointing out that similar cases concerning Justice R.M. Lodha Committee report and the BCCI were pending before Supreme Court, said that the petitioner’s remedy lay only at the apex court.

The Bench said, “The endeavour of the petitioner seems to be to disturb the present administration through a process of a writ rather than under the bye-laws of the society. We cannot permit the same.”

In his petition, Mr. Srinivason submitted that Justice Lodha Committee had observed in its report dated December 18, 2015, that it was not satisfied with the functioning of various bodies associated with the BCCI.

The elected bodies were operating without a structured approach and most of the positions were taken over by influential persons.
