The Madras High Court on Wednesday directed the Election Commission to respond to a representation seeking to frame rules to the effect that if the NOTA gets majority in a constituency, election to that particular constituency be declared null and void.
A Vacation Bench of Justice N. Kirubakaran and Justice N.V. Muralidharan made the direction on a PIL petition moved by advocate Tranquebar Dorai Vasu. “The very purpose of introducing NOTA is to make a change in the existing scenario of election process.
Even if the NOTA votes get majority, and the candidate who gets highest votes would be declared as an elected candidate, it does not change the position which was in existence before introduction of NOTA. Therefore the issue needs to be examined in detail,” the Bench said
