High Court directive on rape case probe

Issues show cause notice on why investigation should not be transferred to some other agency

Stating that the local police have not conducted investigation in the right direction in the rape of a differently-abled girl in Krishnagiri district last month, the Madras High Court on Wednesday directed the Inspector, All Women Police Station, Denkanikotta, to show cause as to why the case should not be transferred to some other agency.

The Inspector should file the reply by January 29.

Justice T.S.Sivagnanam passed the order on a writ petition by the victim’s father, an agriculturist. The petitioner alleged that his daughter was subjected to secondary victimisation due to the “insensitive and faulty investigation” of the police.

In the petition, filed through counsel K.C.Karl Marx, the petitioner said his daughter suffered from speech and hearing impairment. On December 25, four persons waylaid her, hit her on the head with a log and raped her. She had also identified the perpetrators of the crime. But the police did not make any enquiries. Though the incident happened on December 25, the police registered an FIR only on December 31. Even then the necessary provisions of the law were not included in the FIR.

When the victim was taken to the police station, the Inspector slapped her and pressed the small finger of her leg with the boots and harassed the girl to say that nothing had happened. She was not spared even after she screamed in pain, the petitioner alleged, adding that he did not understand as to why the police tortured her in such a way.

Among other things, the petitioner prayed the court to transfer the investigation to the CBI, direct the authorities to pay adequate compensation and register a case against the police for harassing the girl.

Mr.Justice Sivagnanam ordered that in the light of the petitioner’s contentions, he was issuing the directive to the local police. He posted the case for January 29.
