The Chennai Corporation’s pursuit of penalisation of private conservancy operators got another boost with the High Court dismissing the writ petition against the show cause notice for termination issued to Ramky Enviro Engineers Limited.
The show cause notice for termination of the contract was issued by the civic body on September 22, 2012 after Ramky Enviro Engineers Limited allegedly failed to fulfil all the conditions in the tender document.
The conditions include door-to-door collection of garbage, collection of municipal solid waste on the stipulated time, sweeping of streets and night conservancy operations.
“The notice was issued because the performance of the private conservancy operator was not according to the provisions of the contract conditions,” said an official of the civic body. The dismissal of the writ petition filed by Ramky is likely to embolden the civic body in taking more stringent action against the private conservancy operator.
Penal action against the private conservancy operator was proposed in June after Ramky Enviro Engineers found difficult to cope with challenges pertaining to conservancy operations.
According to sources in the Chennai Corporation, the private conservancy operator is likely to face similar action taken against the previous operator, Neel Metal Fanalca, if the operator fails to fulfil all conditions in the tender document. The private conservancy operator was asked to step up night conservancy by adding workers.
The orders of the court are likely to remind Ramky Enviro Engineers of stringent penal provisions of the conservancy contract.
The State government permitted the Chennai Corporation to terminate the conservancy contract with NMF in parts of the city on December 31 2011, after which the new conservancy operator took charge.
The conservancy operator is in charge of solid waste management in three zones of Kodambakkam, Teynampet and Adyar zones.
The special purpose vehicle, Chennai Municipal Solid Waste Pvt. Ltd., set up by Ramky Enviro Engineers, launched operations across all the three zones in January.
