Failed students of Sainik school move HC

The Madras High Court has ordered issuing notice to respondents on petitions filed by parents of 13 students of Sainik School at Amaravathinagar, who had claimed that they were being forced to collect their transfer certificates after they failed in the Class XI examination, contrary to the guidelines laid down by the CBSE.

When the petitions came up for hearing, Justice M. Duraiswamy ordered issuing notice the Principal of the Sainik School and the Regional Director of the CBSE. In their petitions, the parents claimed that the school management had informed them on March 25 this year that their wards did not pass in the Class XI exams and were asked to collect their transfer certificates.

Contending that the action of the school was contrary to the CBSE guidelines that students cannot be asked to collect the transfer certificate even if they had failed in the exam, the Parents Association of Sainik School Amaravathinagar sought the Court to restrain the school management from dropping out any of the students. Observing that the next academic year was to commence on June 1, the petitioners have now moved the High Court seeking to conduct a revaluation of papers of these students by an independent teacher.

The judge posted the matter for May 27.
