The Madras High Court on Friday ordered issue of a notice of motion (admission) on a petition by a woman who has sought a direction to the police to register a case under Section 302 (punishment for murder) of the Indian Penal Code against an Inspector in connection with the death of her son.
She has also sought a direction to the State government to award her compensation.
Justice K. Suguna said the notice would be returnable in four weeks. Bamavati said that on March 25 her son, Natarajan, residing in Chennai, was taken away in a police van. The next day, she came to know that he was killed in an encounter near Pudunelli checkpost in Kancheepuram district.
The police said that her son was riding a motorcycle when they signalled him to stop at the checkpost at 3.30 a.m. on March 26. He hurled petrol bombs. The Inspector, Kancheepuram Taluk police station, K.A. Sampath, fired at him and he died on the spot.
Ms. Bamavati said that she was not allowed to see her son's body. She demanded a re-post-mortem, but the police refused. Despite representing to the government to register a case under Section 302 against the police personnel, this was not done.
