The Principal Sessions Court on Tuesday denied bail to a youth who was arrested in connection with drunken driving and causing the death of a person .
In the early hours of November 2, S. Prasanth (27), a resident of Valmiki Nagar, Thiruvanmiyur, drove his car in a drunken condition and ran over a person, who died on the spot.
The Soundarapandinar Angadi police registered a case against him under sections 279 (rash driving or riding on a public way) and 304(II) (punishment for culpable homicide not amounting to murder) of Indian Penal Code read with Section 185 (driving by a drunken person) of Motor Vehicles Act. He was arrested and remanded to judicial custody. Prasanth filed the bail petition before the Principal Sessions Court.
In his petition, he had said that he had been in custody for five days but was innocent of the offences. The accident occurred due to the negligence of the driver of an unidentified car, the petition stated.
M.L. Jegan, City Public Prosecutor said the petitioner had consumed alcohol and driven the car in a rash and negligent manner.
Declining to grant bail, the Principal Sessions Judge P. Kalaiyarasan said, “In the case on hand, the petitioner drove the car rashly and negligently in a drunken state with the knowledge that such an act would lead to some untoward thing and death was likely to be caused. There is prima facie case for the offence against the petitioner.”

Good, we have to follow the Russians in this and put a law for 0%
alcohol tolerance and to fine minimum of 10 Lakhs for drunk and
driving with 5 years licence suspension and a life sentence in
addition to fine if it has caused a death. These people are playing
with others life while enjoying their drink and cant be treated as
similar to an accident. And can the court instruct the chennai police
to control the speed in the city as most motorist scare/ nearly
injure the pedestrians while they are flying so low and police doesn't seems bothered.
It should be made mandatory that no driver who was held for drunken driving should be given bail ,on any ground.
Why do they want to go on bail? To go out and try their best to buy the people who caught them in the drunken driving condition.
Any driving,either with drinks or without, that had led to a death,is punishable under law and stringent punishment will pave the way for others not to commit,but also the same driver will not do the same mistake.and and further he has to surrender his driving license immeaitely.Depends upon his driving expeirnece,how he was given a permaennt license?In India, proper inspection of issuing driving license is not given unless he undergoes various test,and further needed proper supervison over his driving in a busy Roads, where other transport is also on the move.The punishiment for a year Ri, is not e n ough if this cause death of another.
