The High Court of Karnataka on Tuesday modified an order of conviction and sentence imposed by a trial court on those who stabbed to death Alyosha Kumar, a final-year student at the National Law School of India University (NLSIU), in Jnanabharathi police station limits in September 2007.

A Division Bench of Justice Ravi Malimath and Justice John Micheal Cunha passed the order while allowing the appeals filed by convicts Kallesh, alias Kallesh Gowda, and Seena ,alias Sreenivasa, both residents of Bengaluru.

The Bench convicted the duo on the charges of culpable homicide not amounting to murder (under Section 304 of the IPC) while setting aside the trial court’s order convicting them of committing murder.

Instead of life imprisonment, the HC sentenced them to 10 years in prison, with a provision to set off the period of sentence they have already undergone.

The incident occurred when a group of NLSIU students, who were returning to their campus from a party, had a brawl with a group of youngsters.
